You're very possibly correct..
I've just re-read the OP and one thing that has just struck me is this:
"He set up a payment plan for his first offence…"
You cannot set up a payment plan to pay a fixed penalty. The entire amount must be paid in one go. And it also suggests he had a choice about the points.
As well as this individual case, there seems to be a concerted campaign to get everybody to believe that action is routinely being taken for 22 in a 20mph limit. I don't believe it and won't until I see proof (of which, so far, none has been forthcoming).
