18 Year Old Doing 34 in a 30 stretch caught twice on cameras within 8 mins apart.
My Nephew has had 2 fines for speeding in a 30 zone (he was doing 34). The cameras caught him twice within 8 mins apart.
He set up a payment plan for his first offence and accepted the points (thinking it was over with). He now has another fine and potentially more points.
Will he loose his licence as he hasnt been driving 2 years?

Did his instructor not tell him about speed limits?
Caught doing 34 means it was probably showing 40mph on his speedo.
He clearly needs to take his driving test again. The amount of young drivers tailgating me when I’m doing correct speed on 20 and 30 zones is very annoying

I would suggest that he (not you) should go over to the FTLA forum and post his situation there. Before posting he should read the “Read me First” thread otherwise he will be given a hard time there. There is a possibility that this might be treated as a single offence if he went through two separate speed cameras on the same stretch of road.

Are these his first offences? In England or Wales I would expect him to be offered a speed awareness course for the first one, which would avoid 3 points and having his licence revoked for hitting 6 points in his first two years of driving.2 -
The ruling is that if they get 6 points on their licence then yes it's automatic ban. 18 with 6 points and a Ban is going to be terrible for insurance also. I would seek legal advice.

Was it one continuous offence?
No junctions, no roundabouts, nothing that'd require him to slow or stop between the two, and an average speed over 30mph? That'd require them to be about 4.2 miles apart…
Because - if so - then he's got a potential case, but it'll require him to go to court and prove it. He cannot be penalised twice for a single offence.
However, if he dropped under 30, then they're two separate offences.
I'm also interested in why he didn't get offered a course for the first. Or did he, and he took the fixed penalty instead…?1 -
Is your nephew sure it was a 30mph and not a 20mph limit road? If it was a 30mph please get a copy of the NIP and post here as a ticket for 34 in a 30mph isn't typical as it is below the guidance of 10%+2mph.

As has been suggested get your nephew to post here but please get him to read all the posting and newbies advice as they can be very strict.

Also as above FTLA will be interested to see a notice raised on a 34 in a 30 as it's incredibly rare - if not non existent at that speed.
Just for interest, how long apart where the two notices received as reading the OP it reads as though one was all done and dusted before the 2nd notice was received.

By all means go to FTLA but they will give the same advice and ask the same questions as here.
Since the first offence has been dealt with it is only the second that is of concern.
When you say he “has another fine” what do you mean by that? Has he been offered a fixed penalty (but not a course)? If no course has been offered for either offence, as above, it is possible (in fact, quite likely – unless the offence was in Scotland) that the limit was 40mph.
Tell us exactly what stage he is up to with the second offence.
The ruling is that if they get 6 points on their licence then yes it's automatic ban.
That is incorrect.
When the DVLA learns that he has reached six points they will write to him revoking his licence. He can immediately apply for a new provisional licence and begin driving again (with ‘L’ plates and a supervising driver) as soon as he has it. He will have to take his test (both parts) again.
He should also note that, unlike a “totting up” ban (which is imposed if 12 points are reached within 3 years) revocation does not wipe his record clean of points. The six points will remain “active” for the purposes of a totting up ban for three years from the date of the offences.
He should also check his insurance policy to find out whether he is required to report these points immediately or not until renewal. Some insurers require young drivers to report them immediately.

2 offences, both 34 in a 30, 8 mins apart, one already dealt with but the other just come through?
Would help to clarify all the details here, I get a sense we are being drip-fed info.

Whish is often the problem with a third party reporting what they have been told..

The police guidelines are clear: the starting point for action in a 30 limit is 35. Claims to have been nicked at 34 or lower, when challenged, result in either a correction or an embarrassed silence. This thread will be no different.
