Quck update:
Sainsburys have done a complete U Turn from saying 'bring the letter in from QDR once you get it and we will sort it' to 'we cant do anything about it as'
Yesterday also got an email from QDR solicitors saying they have received my complaint (see below, copied from their letter)

Enc complaints policyShall l just wait for them the Customer Assurance Team to contact me. Because l wrote my concerns re: petrol charges, its gone down as a 'complaint' so l dont know if l should email again. Surely they will pass it on to the right people?
So Sainsburys have refused to help.
Im now waiting for QDPR and see what they say,

I had told my bank to send me a chequebook so l can pay the petrol charge directly ( because if l scan the QR on letter it comes to a set figure incl charges of £65. but as yet they havent sent a chequebook,

Personally, I would wait for a decision, and send them a cheque for the outstanding amount only, the amount that should have been paid by the driver for the petrol, not the inflated costs ( as Car1980 mentioned back on page 1. )

Yep and then warn QDR that you are about to send your evidence to the CMA to investigate fake costs being added, contrary to the case law of 'A Retailer v Ms B and Ms K' which established that fee fakery is unlawful.
Further, fees were not part of the contract formed on site (to pay the cost of the petrol) and add-ons cannot be plucked out of thin air and applied by private companies punitively and disproportionately. Private firms cannot fine or penalise people and must give consumers a fair opportunity to pay, in such circumstances. You wanted to pay the overlooked petrol costs and would have accepted (perhaps) a couple of pounds admin costs to cover the DVLA look up and a template letter. Anything else breaches settled, binding case law and the Consumer Rights Act 2015, as well as flying in the face of the overarching duty of reasonableness and open dealing with consumers.
(we predict QDR will be scared of the CMA, given yesterday's announcement about parking firms. Not that your case is about a parking charge but that sector is QDR's usual bread & butter and they'll know this week from the news, how risky getting on the wrong side of the CMA could be).

I didnt even have a cheque book, as never needed one, so had to ask the bank to send it ( but its taking ages and it still hasnt arrived yet!)
Once it arrives l will write a cheque for the diesel l purchased.
Sainsburys have really let me down . From 'yes we know you as you have always shopped here' and 2 different managers saying 'once the letter arrives give it us and we will sort it' to 'sorry we cant do anything'. And l feel like now writing to Sainsbury Head Office, saying how unprofessional the staff were and frankly speaking yes, they can use discretion and have teh charges waived.
Also one of teh staff member said we cant help you, BUT we can take the markers off your car so you can continue to purchase diesel. Now they are saying they cant even do that so l am buying diesel from elsewhere. They really have been unprofessional.

You need to complain to Sainsburys head office or the CEO by name. How about asking your local MP to help with that?

I have sent the cheque to QDPR for the fuel payment only and not the exaggerated charges. I posted this yesterday afternoon 1st class.
I did receive an email today 12 noon from QDPR (not sure if they emailed me normally or if they received my cheque and have responded)
They were basically saying that are not upholding my complaint so the full sum of £93.41 is payable.
However, there is an interesting part of the letter (that ive circled) in which they say that they ………..cannot overturn any decisions on behalf of their clients unless instructed otherwise.
So in essence if Sainsburys said 'yes he's our regular customer, drop the charges' then QDPR would drop them'
i think its pointless going into store again as they have been useless. maybe it might be worth writing to the Executive Team and giving them a copy of QDPR letter and see what they say.
Any thoughts?
should i reply to QDPR? or just email the Exec Team at Head office with this letter?
please let me know whats best.
