QDR Solicitors letter for unpaid fuel. (Sainsburys)

I am a regular at the local Sainsbury Petrol pump.

3 weeks ago l fuelled up as normal and got distracted and then got in my car casually drove off without paying (totally forgot) then l went in the following week (7 days later) and tried to fuel up, they tannoyed me and l went inside. They said there was a marker on my car as l had driven off. I couldn't believe it, i was shocked that l had been so absent minded and we all had a laugh (as the staff know me there due to being a regular) I got my phone out to pay and they said they couldnt accept payment as its been more than 3 days and its gone to a solicitor and they will write to me. I went and saw 2 managers at the main store and they said not to worry and bring the letter when it comes and they will waive the admin charge of £50.

However that manager is on leave and the other 2 said they cant do anything as its from BOSS (British Oils) and has nothing to do with Sainsbury. eg solicitors are acting for a 3rd party

The dilemma is that today is the last day (only saw it on letter) and tomorrow they will add more charges ,

Has anyone had any dealings with QDR.

Also to add l have been a regular shopper at Sainsbury and at the petrol pump since 2004, its where l do all my shopping and get my fuel (have bank statements to prove)

Is it worth challenging them to drop the admin charge or should l pay.

As it was last day today, i emailed them earlier on the complaints email they had on the letter, stating a) lt was a genuine mistake and b) i went in to pay 7 days later but they wouldn't accept it and c) that l have been a regular there for more than 20 years. Also asked them not t add more charges until l have spoken to the main manager at Sainsbury.

I said l was willing to pay the original amount for the fuel but not the £50 admin charge. Do you think its worth pursuing or should l just pay.

    Today isn't 'the last day'.

    You have also never contractually agreed to any admin fee on top, so that's unrecoverable anyway.

    Show us the QDR letter and relax. Stop taking the bait.

    Wait for the Sainsburys Manager to come back from leave. The sky will not fall in by doing nothing this week.

    This is the letter they sent, ont the other side of teh page there is no further instructions except the QR codes or phone number to pay the charge.

    Coupon-Mad as above i have sent the letter and it does say 14 days, the dat eon the letter is 14th June (is that where the 14 days begins from? or the day that l received letter which was Friday 3rd July.

    It doesn't matter. Forget it and wait for that manager to return.

    There's no real deadline and no recoverable admin fee. There is case law against this (a Retailer v Ms B and Ms K)

    I am waiting for the manager to come back from annual leave on Tuesday 14th.

    In the meantime i got a call from QDR, when their letter first arrived on Friday 3rd July l rang the number continously but couldnt get through. Then the message said there was a call back service so l pressed 1 for that. Lo and behold they rang back a week later!

    The gentleman searched my case through ref no and said that being a customer for 22 years doesnt really mean anything as this is specifically about that one missed payment. He said he wasnt dealing with this and that he just did the 'call back' He said someone will email me in due course, Also he said the charge had now gone up to £93.41 .

    So lm now waiting for someone to email me back from QDR and also for the store manager to come back.

    A part of me thinks i should just pay it as l done want it escalating and more charges.

    As a sidenote does anyone know of QDR do mediation etc or just go straight to court..

    Mediation is a component part of litigation. It has to be offered. The defendant does not have to engage. You’re some way off that at this stage. The increased amount is all part of the game to put pressure on you! Have you read the legal judgment posted by @Car1980 above?

    But I have already told you twice, that they can't recover added fees. And I gave you the case law that confirms it.

    You only owe the money for fuel. Stop panicking.

    Unkomaas and coupon-mad, i did read that case on the link but it didnt make sense to me, at the bottom it said that there was another transcript so l thought it was incomplete. i just got that in the shoplifting case the store added on unreasonable amounts and the courts didnt find it appropriate. (is that what happened?)
