Civil Enforcement Parking Charge

Hi!

Can you please help and confirm if the below parking charge is POFA compliant? I have checked the newbies thread and wording on the POFA section 9. The charge was received via letter on 06.07.26, no windscreen shield. I am no expert and want to ensure I am not misunderstanding.

It references being issued under Schedule 4 of POFA 2012.

Paid for 2 hours parking but overstayed.

It really doesn't matter because these are usually best ignored as there's no independent appeal.

Also you can tell if a NTK is POFA worded or not (if you really want to) by comparing both sides of yours with the images in my NTK pictures thread.

To be fair, from a quick glance it is actually a different version to any of the ones in the thread (note the scan to pay bit which I can't see on previous versions).

This firm were warned by Steve Clark of the BPA years ago (and by the DVLA) that appeals MUST NOT be conditional on saying whether an appellant was driving.

Sigh… the BPA is so weak these days.

I have now received the below letter:

RESPONSE TO REPRESENTATION
We refer to your recent correspondence.

We have carefully reviewed the selected reason for appeal and the evidence provided in relation to this Parking
Charge.

The payment made did not cover the full duration of stay and the vehicle remained parked beyond the time
permitted. It is the responsibility of the driver to ensure they adhere to the parking terms.

It is therefore our position that the Parking Charge was correctly issued as a result of the driver’s breach of the
terms and conditions displayed on the car park signage, specifically: Payment not made / permit not obtained in
accordance with notified terms
.On this occasion, your appeal has been unsuccessful for the and you have now reached the end of our internal
appeals procedure.
You now have two choices:

1. Pay the original amount within 14 days beginning with the date of this letter. To make a payment please visit
   www.ce-service.co.uk.
2. If you are not satisfied with our decision, you may appeal to the Independent Appeals Service (POPLA) via
   www.popla.co.uk using verification code xxxxxxxx within 28 days from the date on this letter. However, if
   you decide to appeal to POPLA, the full charge will apply if the appeal is not upheld in your favour. According to
   the latest data published by POPLA, which you can view at www.popla.co.uk/reports, between 1 October 2023
   to 30 September 2024, POPLA decided in favour of Civil Enforcement Limited and upheld the validity of the PCN
   in 88% of contested cases.

You must now either pay the outstanding amount or appeal to POPLA but you cannot do both. If you do not
choose either of the options above, we will seek to recover the outstanding sum by referring your case to a
third-party debt recovery agent and may commence court action against you. This may incur additional costs
for which you may be liable.

By law we are also required to inform you that Ombudsman Services provides an alternative dispute resolution
service that would be competent to deal with your appeal (www.ombudsman-services.org). However, we have
not chosen to participate in their alternative dispute resolution service. Should you wish to appeal further you
must do so to POPLA, as explained above.

So just follow the POPLA appeals process? It does say 88% of appeals at POPLA are upheld in their favour?
