Is there a 2 year wait, before you can apply for PIP again after residency fail?
So I failed residency I was out the country for 3 years , I failed the appeal. Its now 1.6 years since arriving back to the UK.

Damn so I could have been getting PIP all this time but just because I appealed I lost 1.5 years of PIP, that doesn't seem right?

maybe not right but it's your responsibility to investigate and make an application when eligible. Nobody is going to chase you with the information.

it saves them money to make the appeal process last?
they also didnt tell me it was impossible for me to win it, despite knowing , I dont fit the exemptions at all and they knew that from the start ?

As others have mentioned, you can reapply as soon as you meet the residency requirements, which you previously failed.

The eligibility link I posted above explains the requirements for eligibility. You either meet them or you don't. Everyone has the right to appeal if they do not agree with the decision.

you have a right to make a claim to PIP even if you don't meet the requirements for a successful claim, its not their job to stop you trying.
