Euro Carparks fine petrol station
- Hi everyone,
I received a Euro car parks fine for apparently staying in a petrol station for too long (35 minutes). I filled up petrol and air/screenwash and cleaned out the car (I have receipts for petrol and air).
Today is the last of the 28 days for ‘payment to be made’. The car is a lease car and I am the hirer.
What should I do?
Thanks

It's not a fine.
Post up the Notice to Hirer which you have received.

Thanks for your reply.
I’ve redacted the details but can alter it if needed.

Its definitely NOT a fine, magistrates issue fines, not ECP
Ideally, follow plan A and complain about it to the Motor Fuels Group, MFG , ASAP
Is that PCN above addressed to you with your name and address on it. ?
Or
Is it addressed to the lease company who may have forwarded it to you. ?
It seems to me that you have posted the NTK PCN letter addressed to Lex Auto leasing in Stockport, so is a copy, you haven't received it, LEX received it

have lex auto charged you anything for this?
as a lease company is involved it's even more important that you never call this a fine, or a penalty.
From the Plain Language Commission:

Challenge using advice here:
Presumably Lex haven't paid it. Make sure they don't.5 -
Tell LEX to name you as hirer to ECP, ( as advised in the BVRLA Memorandum of Understanding ) , giving your name and address as Hirer
Then wait for the actual NTH pcn to arrive at your address, with your name and address on the pcn
Then you can use the Edna Basher advice to appeal it as a hirer ( not as the driver)
The Edna Basher advice is at the bottom of the 1st post in the newbies sticky thread in announcements near the top of the forum by coupon mad
You need to follow the above advice carefully, if you want to win against ECP
Personally I would separately complain about it to MFG, as a hirer ( not as a driver. ) with copies of the receipts and get them to lean on ECP to cancel it
Definitely do not tell anyone who was driving whilst carrying out these tasks
For future reference, you should probably have registered the VRM details inside the kiosk, to gain more time

That is correct, the PCN is addressed to the lease company who has forwarded it to me.
It would appear they have charged their £10 admin fee - am I correct in thinking I should be able to get this back?
Thanks - that’s a good point - I didn’t even think of asking for more time especially as the petrol station was completely empty at the crack of dawn.
I will contact Lex to name me as hirer - with other (council) PCNs in the past when leasing they have just reissued the paperwork in the name of the hirer after the initial 28 days has passed. Is there any chance they do the same this time or is the process different with ECP? I’m also wondering if I should go into the petrol station and ask whoever is there (usually one person to be fair).

Can you please state the date issued of the NtK?

If the pcn was forwarded, you should have said so in the first post, the devil is in the detail
The issue date of that NTK is important, yet you redacted it
You should be checking if LEX have already named you as hirer following the BVRLA Memorandum of Understanding, and informed you of the impending NTH in your name and address, as a courtesy ( possibly charging you £10 for that courtesy)
Your hire or lease contract will determine if you can get the £10 back or not, nothing to do with parking, but contract law between you and LEX
In theory you wait for the NTH to arrive in the post, meanwhile checking that LEX named you as hirer, transferring liability from LEX to said hirer
There Is no time limit on naming the hirer ( or even the driver, if known ) but it must be done BEFORE any court claim is started, and yes , ECP issue hundreds or thousands of court claims via DCB Legal annually
The MFG - ECP scammery is of their own making, by insisting on a time limit of between say 10 and 30 minutes, whereas 45 minutes or 60 minutes would be more reasonable to drivers who use multiple devices or shopping on site
But it happens a lot recently, unrealistic time limits everywhere

First you must complain to MFG and not be fobbed off by that guy who always does!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
