Just a quick update on this (thanks all for the replies). I’ve been into the petrol station three times asking for a manager. I was firstly told that the manager was in between 6am and 2pm. I returned twice to be met with apparent confusion as to whether a manager existed. Not quite sure if it’s poor English or a good dose of playing the fool (I have my suspicions). All of them did have good enough English to tell me to contact ECP!

Needless to say I’m not going back to this petrol station again - I noticed signs when I visited saying 15 minutes max time!

I have received a ‘final’ notice to the hirer - bearing in mind the first letter was addressed to Lex - I was expecting a reissued first notice to me but they skipped that and went straight to the final notice.

If I call MFG directly who do I say I am - just the hirer or do I not mention anything? The actual hirer is a family member and I usually drive the car so any guidance on what I should say would be much appreciated.

I’m attaching both notices without the date redacted as in the original as I didn’t realise I’d done that - thanks for pointing out @Gr1pr

So have you received a Notice to Hirer?

Yes - the final notification letter I posted is addressed to the hirer. But the original Notice to Keeper was addressed to Lex.

"The actual hirer is a family member "

So they (not you) appeal as hirer to that July Notice today, copying the wording for hired cars at the bottom of post 1 of the NEWBIES thread. The hirer can appeal.

Get them to do that today.

But there's a LOT more you need to know!

This is effectively the NTH (the first notice sent to the named hirer) but Euro Car Parks has removed the discount!

Heinous bare-faced rogue conduct. Notices issued for the first time (or reissued if not received) must be at the original rate including discount.

Never mind going in to try to find a manager; I thought your relative would have emailed the CEO of MFG by now and had it easily cancelled?

Do that IN THE NAME OF THE HIRER (but use your email address so you see the reply) and link the CEO of MFG to the gov.uk page about the CMA's investigation into Euro Car Parks and ask if they are ending the contract in view of the situation?

… surely you have read the news about the CMA opening an investigation into Euro Car Parks' unfair PCN activity at petrol stations?!

Surely? Google it, if this is news to you!

Your relative (NOT YOU, THE DRIVER DOES NOT GET INVOLVED) should also be emailing your evidence to the CMA like everyone else on here this past month! They want evidence about ECP at petrol stations and your case includes proof that even when a hirer is named, they sent an unclear 'final notice' (second class post, arrived very late?) denying the recipient the discount and not explaining that in fact this is a Notice to Hirer, which must offer the discount and a right to appeal.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Surely having a notice which 'triples' as either a reminder to the NtK / new NtD / new NtH is very sharp practice given that the details which need to be contained within each notice differ??

Amazing! Thank you for this information! I had no idea there was an investigation. I will certainly be providing the evidence as you’ve suggested.

I spoke to someone at MFG today and they sent an email requesting receipts and a copy of the ‘PCN’. I asked if I should still speak through ECP and he said there was no need as they would go back to MFG in any case. But I’m going to follow your advice and (my relative) will appeal today. There are a couple of templates for hirers - am I correct in thinking any will do?

There are three templates written by @Edna_Basher just pick the one that nearest suits your position, hirer/lessee/rental/fleet

    Yep.. as usual…

But you already know that your relative must email the MFG CEO. Not you. The hirer.

This is described in a post about a successful MFG complaint in 'Successful Complaints About PPCs' and I already told you (weeks ago, in June) not to stop when the first person at MFG fobs off your relative.

And your relative can also show the CEO the gov.uk page about the consumer protection investigation into Euro Car Parks, as it is specifically looking at petrol stations. Ask the MFG CEO: are MFG aware of this new investigation? Why aren't they distancing themselves, cancelling all unfair PCNs issued to site users and ending the contract?
