Non-POFA PCN:

Smart admitted that in the auto-rejection of appeal - lied that they could presume a keeper was the driver - and said "the POFA doesn't apply at this location":

Yet Debt Recovery Plus talk about the POFA and are saying the keeper recipient owes a debt:

That wording headed up 'liability' implies that the position is that the keeper is liable in E&W.

But we know this is a non-POFA NTK.

The keeper's data in a non-PoFA case is only given by the DVLA for the single, limited data purpose of 'enquiring who was driving'. Not to pursue a keeper and call it "your debt".

Debt Recovery Plus also have this highly misleading graphic telling the recipient that after recommending legal action, a CCJ will just follow (impossible) and that the 'charge' will be an inflated £280, which no court would grant:

Pretty shocking letter in terms of misleading the public.
