Hi All, I have read through the advice that others have kindly put up and followed it up to now, but now not sure of my next move. We have appealed this NTK PC with the template appeal in the newbie section. They have turned it down. Any help on the next steps or pointers would be most excellent thank you in advance.

Also it was sent 16 days after the alleged offence, is that ok?

Have a search of the forum for other Smart Parking threads. There are loads of them. Also compare your NTK with others to see if it is POFA compliant

@cooldude255220 might stop by this thread and draft you the basics of an IAS appeal that has a chance.

IAS is a kangaroo court but give it a go as 20% or more see charges dropped by the operator.

You WILL NOT be paying anyway.

As Coupon says it's by no means a guaranteed win at the IAS, but there's a 20-25% chance (ish) that the operator concedes, and if they don't you ended up costing them a bit of money whether or not you win or lose.

There was NO offence, just an alleged breach of the parking contract on that private property at the redacted location

They have 6 months to obtain keeper details and one month to get the pcn to the keeper, under their DVLA KADOE contract

The 16 days later just means that they cannot invoke Pofa2012, so no keeper liability, hence why people here questioned you about was the driver revealed or not

Without seeing the back of the Notice I can't be sure if there are any other points to include, but really the biggy is that it is out of time for keeper liability to attach.

You just need to include your PCN number in the orange box at the start of the appeal document. Everything else should be ready to go. Make sure that you upload all the attachments to your appeal.
