Totally agree. Do not do Mediation. Like I already told you, cancel that day off!

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Hi,

Thanks for your reply (and to everyone else).

I've just checked, since I replied to the county court (a couple of months back to say I will be defending this claim) the only official letter thing I have received is attached from Northampton

    Confirmation letter from Northampton.jpg

I'm not really familiar with the whole system/steps, so I assumed the mediation hearing was a mandatory part of the process that I would have to 'attend' (take the call for), otherwise I would be found as not attending and automatically guilty etc.

As I understand it, the 'mediation call' will be from the cowboy company then/their representatives? Rather than from the courts?

I havent booked the day off from work yet (thanks for the concern), and if its just a call from the cowboys that I have an option of ignoring, then I'm happy to do so.

It is a mandatory stage, but not mandatory to take the mediation stage call , or you can let somebody else take the call on your behalf , which it does indicate on your letter above

If you look at the top right of the claim forms you will see that it came from the CNBC in Northampton, a civil service office, it is NOT a county court, so attention to detail is important here, same as in your job, no actual court is mentioned because no county court has been allocated yet

I tell you these things to get clarity, nothing personal, please learn from the replies

The Mediation Service is a court appointed 3rd party resource, nothing to do with any companies or lawyers

The call comes from the 3rd party Mediator as part of the Justice system, an intermediary, the Mediation Service

Perhaps you can get someone else to take this call and say

Hello, thank you for the call, there will be no offers made or accepted and no settlement today, thank you and goodbye

Also I've tracked my text messages, and I sent a text to my wife on the day to say I was at Halfords and that I would be home soon (to pick family up) and go to this car park.

My text message is dated and timestamped as 9 minutes before I allegedly entered this car park.

My text message from within Halfords is 12.01pm and the CCTV shot of me allegedly entering the car park (in city centre, several miles away) is 12.10pm

    SMS on day.jpg Incoming time.jpg

Now I have checked, and there are a couple of Halfords store within 5minutes driving distance to this car park unfortunately, so I cant use the argument that theoretically its impossible to get from any Halfords store to this car park within 9 minutes.

So this text message probably wont hold much weight. But I am a million percent sure I did NOT enter the car park at the timestamp they are showing. I lucidly remember this day's events even before I found this text message, but this further confirms in no way did I enter the car park at the image timed stamp they are purporting I did.

I was in Halfords sorting out a dashcam issue (this Halfords is near my home, a few miles away from the city centre car park), I then went home to pick family up from home and then we went into city centre to this car park arriving shortly after 1pm. So I know what they are presenting is completely untrue.

What I am at a loss is how on earth they have come up with an image - or the audacity if this is intentional - to 'prove' I had entered the car park an hour earlier than I had. And now are taking me all the way to court for it (or threatening to at least).

Sorry if it sounds like I am fuming, but this is pure injustice. And whether I can say it in court or not - it is 100% fraud in my opinion.

None of that matters for the mediation stage, because you do not discuss the case at all

At the moment there is no indication of it going to a hearing in the court that you nominated in your N180 DQ document

Plus DE Gladstones would have to pay a hearing fee in order to keep the claim alive

As they are in receivership or similar, they would need the administrator to authorise court proceedings, same as NCP

The WS stage is a long way off, perhaps 6 to 9 months or more

Stick to dealing with the stages, at the moment its only at the mediation stage next month, no biggie, just what I explained earlier, a simple 2 minutes call ( or ignore. )
