The £14 interest charge has been calculated on the £170 starting from the contravention date!

That cannot be the case as it states on the claim "from the date hereof". This means interest will be calculated from the date of the County Court claim, which was 9th June 2026. Or am I missing something here?

@Gr1pr thanks , really appreciate it will do. My bad on PW didn’t think it was relevant without claim number.

@OldBugger looks like it’s the interest of 8% as just over a year :@

With an issue date of 09/06/26 and providing you complete(d) the AoS before or on 28/06/26 your defence deadline date is 4.00 p.m. on 13/07/26

Hi, looking for some advice on point 3 of my defence, sorry my litigation grammar isn't great.

Should I mention the interest error somewhere also ?

The breach claimed is that the vehicle was parked in a 'registered
users only' section, attached to a retail car park that is free
parking. The defendant did not park in the car park that is
clearly for registered users but the side road leading to this.
The defendant's original appeal to the Claimant was that there is
signage within this section upon entry, that relates to the free
car park and read these terms. The claimant provided photographic
evidence of other signage within the section, however the
Defendant stands by that the signage is misleading. The Defendant
acknowledges that POPLA also rejected the appeal, an offer of
settlement was made by the Defendant after this which was
    rejected.

No idea if there is an 'interest error' because the forum team removed your image and you haven't reposted it.

Does this seem decent wording for paragraph 3 though?

I will repost the interest, it seems they have added 8% from the date of the contravention (26/05/2025) rather than the claim date . £184.00 (claimed against £170.00). Might be a reason for them to discontinue also as the claim is technically incorrect?

That is a relevant extra point and a good spot by @OldBugger but it doesn't need a special mention in defence & won't 'lead to discontinuance' because these claims are ALL discontinued before hearings, regardless.

  • I have a mediation date set for end of October now and DCB are trying to phone me every now and then. Should they be allowed to make direct contact now? Any advice also on how to settle for as little as possible at mediation would be appreciated please. Thanks
