Thank you, I have appealed to the VCS first choosing the signage option and pasted this into the appeal comment.

You have sent a non-POFA NTK so you have no cause of action against me.


Under contract law there is no lawful presumption that the keeper was the driver. This was tested on appeal and the parking firm lost (VCS v Ian Edward).

You also have no chance at POPLA because your entrance signs are not compliant with the Joint Code of Practice. Send me a POPLA code, or cancel.

Of course it's a non-POFA case because it was issued at an Airport. POFA doesn't apply.

But POPLA isn't available so it doesn't make much sense and you didn't say what I told you to say about lack of double red lines.

I did tell you to read up in the IAS and to appeal specifically on lack of red lines.

Believe it or not i spent over an hour on Newbies looking for the right reply to appeal but i read so many different things what to do and got confused in it all and clearly misunderstood POFA ans POPLA and chose the wrong one in the end. From what i read it was destined to fail anyway and i would still have jump through a few hoops before an end to this so I will wait for their response and come back here with it. I'm sure you already know word for word what it will be. If the £60 option was still available I would pay it rather than spend so many hours trying to fight it but £100 is different.

Thank you for getting in contact with us. By way of introduction, my name is Edward and I am one of the Customer Feedback Team for East Midlands Airport.

VCS, also known as Excel Parking, are a third party company who enforce the "No Stopping" zone in operation in and around the airport site and separately also at the adjacent petrol station, issuing charge notices to people in contravention of this. As such, you would need to take any correspondence in appeal of your charge notice up with them directly. We would not be able to assist with this.

You should find the information to appeal your charge notice in any correspondence they have sent you, including any escalation process as necessary, or you can also visit .

While we would not be able to assist further with this matter, I hope this helps point you in the right direction.

No it doesn't point me in the right direction and of course EMA can (and do) step in and cancel unfair charges. Do you need me to get a national newspaper involved?

Not only are VCS not "also known as Excel Parking" (they are separate companies) but:

• there is no independent or impartial 'appeal process offered because the IAS is owned by the same entity as the IPC trade body, and
• The vehicle was not stopped on or adjacent to double red lines.

You cannot enforce a 'no stopping zone' without double red lines. Take a look at the images or kindly escalate my complaint to somebody who will actually look at the photos and who will not fob me off with self-serving anti-consumer twaddle fed to your team by VCS.

Did you know the Government is stepping in with statutory regulation this year because the industry your Airport has contracted with is rogue and out of control?

I expect a more considered response. At least you have a customer service ethic. Parking firms don't, and they are dragging you down to their level.

Does your Airport even care that you are inflicting the notorious ex-wheelclamper known as Captain Clampit on users? Google him… How does Mr Renshaw-Smith explain away a 'no-stopping' PCN yet the area in question has no double red lines?

How can you possibly condone this rubbish?

This is now a formal complaint against EMA..
