You seem to be making up your own procedure. Also, the ombudsman isn't going to help, I believe the waiting list to have a case looked at is over a year.

He said he wanted me to try another car. I feel that my requests are reasonable plus I only requested it it wasn't a demand or else. As it was bought on finance both the Ombudsman and Motor Ombudsman can help.
I am hoping the finance team (who own the car) just tell them to take it back. I am fed up of them (not anyone here) making me feel like a liar and a con artist.
I also spoke to the Citizens Advice and followed all their instructions. I can't imagine i'm not allowed to report the car and what happened to DVSA. Even if they agree with the dealership it is what it is0 -
Thank you for this :) I have CC'ed them into all correspondence now.

Just as an update I spoke to citizens advice and they concluded the dealer should be taking it back.
There was a bit of drama:
- I requested a technician be sent to me and the dealership declined due to cost
- The dealership advised they don't want the car back due to the cost involved with having to fix and then resell it in the event that they lost the case. I believe to emotionally manipulate me
- When I asked if I went would they pay me petrol to get to them and then could I do what they asked and drive another same model to see if it happens they declined citing "heavy traffic" in the area and they would request a technician assesses it on site
- They advised that the ombudsman is there to protect them and that me doing so would cost them money and they wouldn't agree with me anyway as they are there to make sure his dealership is okay.
Following this and the fact his friend in head office (who he admitted he'd known years) are putting in roadblocks I decided to do the following:
- Escalate this to the ombudsman
- Spoke to the legal team at my home insurance who are raising a case
- Declare the car SORN and keep it insured so the asset is protected
- Added all costs of travel and insurance whilst SORN from moment of SORN to conclusion to my case
Out of interest if I went to the media or wrote a review that spoke honestly about my experience and is true to the facts of what happened and my feelings about them can I get in trouble?

Pure punt of a thought, the vehicles we use for work (Volvo XC 90s) have a setting that limits your speed for the road they are on, but they are a bit vague when the road changes speeds. I work on the motorway so very regularly come off the motorway spin round the roundabout and go back the other way. On the slip roads with the feature on it can limit the speed on the entry slips cause it hasn't adjusted to the new speed limit.
Just with it limiting you above 30 could it be something similar?
Easily turned off on the Volvo no idea on a Suzuki

It happens with all the safety features turned off so God knows what it is haha. I just think the cars a dud and I got unlucky both with the car and dealership I'm not bitter or anything but I am not taking a 6k hit for them haha.
Hopefully the more I ramp up the pressure the more they change their mind course they could just dig in but they weren't playing ball before anyway
