Truth be told I am angry the way they spoke and dismissed the issue has really got under my skin
I sent them dash cam footage of the car taking up to 4 seconds to move from a stopped position (at a traffic light) narrating it was it went as well as it manoeuvering right. Interestingly during their tests they turned off the camera. I refuse to trawl through hours of footage to prove it to them
They said the car is "perfect" so asked for a written and signed confirmation that the errors I advised were not present because it's perfect if they don't then I will also use this to show they aren't as confident in the car.
If they insist on me bringing the car to them or an independent inspection I shall get a few quotes and charge it to them.
I spoke to citizens advice who said now it's happened again I don't have to do anything it's on them to give a refund
I also sent a final right to reject via signed delivery to Suzuki finance and the dealership.
If they keep pushing me then I will exercise any and all rights I can including ombudsman, court and media interest.
I have dates and now video evidence I think they'd struggle to win from the ombudsman.
It sounds cold but I honestly don't care if the cars devalued or they have to pay for cleaning or whatnot I don't want a dangerous car or a car stripped of the very features I bought it for

If I understand the above correctly, you have the fault captured on video, but its buried within hours of dash cam footage. Does it have audio too or just video? If it were edited down to the succinct event, would it clearly show a fault or be up for interpretation or opinion?

Someone correct me if I am wrong but I think they can also deduct a reasonable amount for the miles you have had use of the car if you do end up getting a refund, just something to keep in mind that you may not get the full amount back.
If it's filthy inside and out too you may see a cleaning charge added.

Apologies I didn't make it clear.
Yesterday they brought it back and I went out (dash cam on audio and video) and it happened again. I started narrating what was happening so for instance if the car was pulling me and I adjusted I would say so and said when I pressed the accelerator and it didn't go including a count down. I sent them that footage. I just don't want to trawl through hours more for more for them to show it repeated before and it's the same thing if they ask. You can hear the car on and the van in front of me on both occasions at the traffic lights moves off a good 3-4 seconds before I can even start going.
In the letter I stated they can deduct mileage :) just kinda annoyed he said even if it's faulty I wouldn't get anything back which is false. It needs a wash which I could do but is far from filthy and I've got videos of the condition in and out in case they say anything

Out of interest would a passenger corroborating the footage and issue count or because they are known to me

I don't know, I'm not the garage. They could "refund and move on", or they could Phoenix themselves, and all shades in between.

I know I just worry I need an independent witness in the car rather than someone I know.

The same happens with many dodgy companies. As soon as the old company hits financial problems, the owner shuts it down and starts a new company. The new company has none of the debts of the old one.
Some owners stay ahead of the game by having multiple companies open at the same time, so when one goes bust, they immediately start trading using the next one.
If it sticks, force it.
If it breaks, well it wasn't working right anyway.1 -
As far as I'm aware it's an official Suzuki dealership so hopefully tomorrow it gets sorted. If their director is rude or anything I'll just send all my evidence to the relevant ombudsman's and put in a request for stress. Even if the likelihood is incredibly small it is what it is. The way they've been has just wound me up.
