are you sure it is a problem with the car?
Some auto boxes are not good and do seem to take a few seconds before they go
MG are like that or were when I had one on hire
And the lane control can feel like it is pulling you in the direction of the line when in fact it is doing the opposite

Would the ombudsman agree with that though? Feels a bit unfair that he wouldn't matter at all when he was in the car. I only have their word for it they couldn't replicate it given they turned off my camera. I have camera evidence and me narrating it (at the same time as the issue is happening) and he was in the car too saying it happened.
It surely shouldn't take up to and over 4 seconds though with the throttle down?
It's dangerous if it does that surely because if someone assumes I am going to go and starts they'll go into the back of me. I'm not thinking about the insurance aspect of it or saying said person would be innocent it just puts me in a dangerous spot is what I mean. I tried to upload a video but it said it did not have an allowed extension. How would I make sure it does?0 -
Your passenger is irrelevant
If they stick to their guns then you might have to get an independent report of even just take it to a different dealer.
They aren't going to refund off what you say or some iffy camera footage. If they did people would be buying new cars and making up faults for refunds all the time.

That seems heavily weighted for them to the point that I think it's just really unfair. I get what you mean that people may make up faults but for all I know they made up the "perfect" report and lied about the fault not being present.
I would ask why they took the car for a drive and unplugged the dash cam. I get that they won't film them working on the car but it seems highly suspicious THEY didn't film themselves on my dash cam for the sake of proving it was "perfect"
I am NOT saying they lied but I have far more evidence that I didn't than they have they have that they aren't. Any bad faith dealer (not that I am suggesting they are) could just fudge it.
If I go to an independent garage could I even claim it back?0 -
With regards of unplugging the dash, they probably just don't want customers watching how they test cars.

What does your dash cam with narration actually prove? Is it showing your foot pressing the accelerator with no response from the vehicle? If not how can you prove that you're actually pressing the pedal? The narration doesn't prove that without doubt.
I'm not saying you are lying, I believe you, but I think you need some more solid evidence.
And it's not really dangerous. Not everyone pulls away immediately or quickly. I'm often behind drivers at lights who seem to take an age to respond to a green light, I've never driven in to the back of them.

If it happens so often, then passenger can record how the driver is pressing the pedal and nothing happens. I think, new video should be good enough. And also make sure you always involve finance company. I successfully rejected Cupra by contacting finance company. They just terminated the lease, gave me 75% of my payments back and took the car. And it was after 8 months and one attempt by dealership to fix issue with infotainment/cruise control.

I get that they don't want me to know how they test the car but surely they want to show me on the open road that it IS working perfectly. It's not as if anything sensitive would be shown

In the interest of fairness for all parties and because I am deeply upset by their response I have decided to do the following:
1) If Suzuki finance say no to the return I will bring the car to them (I will insist on a contribution to petrol) and offer to take out a different Suzuki Swift (same model just not mine. They insist if I do that the 'fault' will be present on that too because it's standard) and IF it doesn't happen on that one they will commit to the refund.
2) He asked me to be polite to his staff (I was and even acknowledged how good and friendly they were) but to me came across as rude and as such I asked him for politeness in return.
3)If they want an independent mechanic at the very least we go 50/50 on payment.
I am aware the next one may anger them but I will also report the car to the DVSA. Get as many eyes on the case. If ALL of them and the Ombudsman agree with the dealer I will drop it.0
