NOWTV 14 day cooling off period- when is it valid?

  • Thank you for your sensible response, this is what I also don't understand. Anyone else would just cancel it, I also don't mind paying for a month that has passed, I just don't want to pay for the remaining 11 for a service that is not what was expected.

  • You waive your rights to a 14 day cooling off period when the service starts immediately.

    Are you paying by card? You could contact the card provider to cancel ongoing card transactions to NowTV and it would then depend on how determined NowTV are to hold you to the contract.

    Keep stating that it's UK law doesn't make it so when you're ignoring any other clauses or caveats in that same law.

    From NowTVs 'terms and conditions' at the bottom of their webpage:-

    13. YOUR RIGHT TO CHANGE YOUR MIND

    13.1 

    Cancellation period for any membership or viewing add-on

    Except where you purchased or activated a membership or viewing add-on and agreed at that point you would lose the right to cancel, you have the right to cancel your purchase of a membership or viewing add-on, and receive a full refund, without giving any reason at any time up to 14 days (“cooling off period”) from the later of:

    (2) In the case of a service other than supply of water, gas, electricity or district heating, the consumer ceases to have the right to cancel a service contract under regulation 29(1) if the service has been fully performed,

    (4) Where the service is supplied in response to a request in accordance with paragraph (1), the consumer must (subject to paragraph (6)) pay to the trader an amount—

    (a)for the supply of the service for the period for which it is supplied, ending with the time when the trader is informed of the consumer's decision to cancel the contract, in accordance with regulation 32(2), and

    (b)which is in proportion to what has been supplied, in comparison with the full coverage of the contract.

    If the service is fully performed before you cancel then it's a done deal, a long term supply of service can't be fully performed in the cancellation period so right of cancellation applies and you pay for the service you got (in this case the number of days).

    As the two companies are different they have different T&Cs.

    NowTV make the exceptions to the 14 day cooling off period clear.

    Things that are different: draw & drawer, brought & bought, loose & lose, dose & does, payed & paid

  • Hi, not sure what your issue is with my query, I have had some responses that are very helpful. The live races are on at different times which is why the OnDemand service is available. I do understand how TV works and live events, that is not what I am questioning. Please find a new hobby.

    Not even the BBC put live content onto the iPlayer the moment the programme finishes, they take time to upload and as they are live programmes they may have to go through compliance to ensure any swearing is bleeped etc.

    But generally ALL overnight F1 races are repeated on the F1 channel 7/8/9am Sunday mornings and then again through the day, this may be before they appear on catch up. In any case the overnight races are done for a bit now arent they?

  • I stand corrected about cooling off periods - I note that they can charge you for the days of service you had from them and deduct it from any refund.

    My point about getting the card issuer involved in cancelling the continuous payment authority remains. They could also raise a chargeback if NowTV ignore the cancellation instructions and take a further payment.
