If you have received a Notice of Discontinuance, it is over, you have won.

Their email reads that I have to file the attached notice with the court?

If that has a claim number on it with 'GM' in it, then there was a live claim. But it isn't for you to lodge with the court!

I don't think you had a claim though? Does the claim ref include 'GM'?

It does indeed, its an 8 digit reference with GM after the first two digits (**GM****)

But you're quite right, as far as im aware, there hasnt been any claim letter come through.

is there somewhere I can run the reference through to check if its live or not?

You should ring the CNBC and ask them if there is a claim in your name under that ref, and if yes, which address was it sent to and on what date?

    What a mess.

    • 18th June - CEL emailed me on the apoligised for breaching COP and said they'd put everything on hold and offered me the reduced charge (they didnt say there was a timeframe for this).
    • 26th June - I repsonded highlighting the COP breach and asking they cancel it entirely.
    • 29th June - they say they'll cancel and send me the discontunance notice (for me to file with the court)

well today, I recieved the claim form and I called the court to find out what the hell is going on.

so CEL issued the claim on the 25th June, 7 days after their "we'll put it on hold and offer you another POPLA code) email. (obviously i didnt know this at the time).

Apparently there's 5 days built into the process between the issue date (25th) and the actual start date of the claim (30th).

so they've sent and dated the discontinance notice for the 29th June, a day before the actual start date of the claim…

she was just as confused as I was about them discontinuing a claim before its even started and we had a little laugh about it.

Anyway, she's confirmed that CEL have also sent the email and discontinuance notice to them (so no idea why they asked me to), and she advised I call at the end of next week (considering the AOS timeline) to double check its been processed and discontinued (unless of course i receive a letter confirming of course).

Hopefully this is all done now, but i'll confirm at the end of next week - I'm cautiously optimistic, but I don't want to celebrate until it's confirmed!

oh and here's the particulars of claim if its of interest…

Their in-house litigation team is a shambles.

Apoliges, I've been a bit busy of late but just a final update from me.

The Court portal confirmed the case has been discontinued, so that's the end of that.

I never heard back from any of the local press unfortunately, but it was worth a try.

I also received a response to my formal complaint from the Parish Council. To be honest, it was a pretty poor and pathetic response - not that I expected much, but it was particularly disappointing given they had told me the full Council would undertake a thorough review of their processes and documentation.

Instead, they largely ignored many of the key points I'd raised, defended the status quo and dismissed concerns without really addressing them.

I've replied, gone through their response point by point and picked apart what I considered to be the more nonsensical parts of it. I also made it clear that I don't expect or want a further response. My intention is simply to ensure everything is on record.

If, one day, the parking company ever seeks to rely on the clawback provisions in the contract, there will at least be a clear paper trail showing that they were warned about the issues and chose to dismiss them.

Anyway, thanks again to everyone on here for all the advice and support throughout this. It really has been appreciated!!
