Ocean Parking - Manchester Metrolink - Parked after operation hours

Hello,

I received a private PCN operating for manchester metrolink after not realising I'm not supposed to leave my car in the car park (sale station) after operation hours (whoops).

I've read the newbie post and this post where from the same company the appeal was successful:

I'm very new to any kind of appealing parking tickets, have only done so successfully with a supermarket by talking to the instore manager. Though I've read the above resources it is a bit difficult to wrap my head round some of it. I'm essentially wondering as given the PCN is objectively my bad since I didn't read the signs, is this still worth appealing/fighting or should I just pay the reduced rate? Sorry if I've irked anyone from missing something obvious, I did try and do some research and recommended reading before posting.

I've attached the PCN letter and pictures of the signage, (which does have fairly big writing that say s no overnight parking).

    Maybe me but the sign ( and the contract says "no overnight parking" ).

    1. how do they not know you left the car park at 01:45?
    2. I think there is a term for this type of contract a "forbidding contract term"

    as always when you appeal don't name the driver - just the keeper.

    It's worth noting that Ocean seem to have changed from BPA to the IPC since that thread, so you don't have the option of appealing to POPLA, only to the IAS.

    Nevertheless, I would appeal to Ocean along the following lines. Do not identify who was driving, appeal as the keeper.

    1. The land in question is not relevant land because it is land on which parking of a vehicle is subject to statutory control. Sale Station is subject to the The Greater Manchester Metrolink System Byelaws. Byelaw 14 of those byelaws relates to parking. Therefore, in accordance with Schedule 4(3)(1)(c) of the Protection of Freedoms Act 2012, the land is not relevant land. The keeper of the vehicle cannot therefore have any liability under POFA.

    You also need to redact the PCN reference and your reg and any other identifying details.

    Make sure you DON'T say or imply who was driving, obviously.

    Secondly, don't expect it to work. It won't.

    Thirdly, do NOT try the IAS but you'll know that already from reading post 3 of NEWBIES PLEASE READ THESE FAQS FIRST

    Is there a reason to not try the IAS other than it might put the heebie jeebies into people when they most likely reject the appeal? I only ask because they have been known (on rare occasions) to see sense, and seeing as an appeal costs the PPC some money, may as well make the process less profitable for them by submitting an appeal, no?
