Ocean Parking - Metrolink Manchester

Good Evening,

Been a member on this forum for a few years, and in that time have successfully won appeals using the advice and support from the members of this forum so a big thank you.

The driver of a vehicle received a windscreen PCN from Ocean Parking (Anchor Security Services) for 'parking in a hatched area' on a Metrolink (Manchester) Car Park. The Metrolink station is a tram station but also a National Rail train station. The parking charge is £100, reduced to £60 if paid within the allotted time. The notice references Schedule 4 of PoFA 2012.

Keeper wishes to appeal against the PCN and will use the blue template in the Newbies thread exactly word for word, and include The Keeper's details at the bottom. No other information will be sent. Keeper will send the template appeal on day 26th after PCN issue.

It is expected this appeal will be rejected by Ocean Parking, and if so, POPLA appeal will be drafted using previous threads specifically relating to Metrolink and byelaws. Please share any other reasons you think would be beneficial?

    Disappointing to see that on neither of your other two threads did you come back and tell us the results at the time.

    The only way we get any clue that the suggestions offered do actually work is if people come back and tell us.

    Hi all, just to update, keeper appealed the PCN using the newbies template yesterday on day 26 after PCN. Will update on the outcome of this as and when..

    By way of an update, PCN appeal rejected by Ocean Parking as expected on 10/10/22 and POPLA code issued. Also, annoyingly the postal NTK received today so within the 56 day limit. 

    Now to draft my POPLA appeal. Will include byelaws and Metrolink land, operator not showing individual being pursued is driver. I’ve done some research and quite a bit of info in this thread which I’ve grateful for. Any other points to include? Thank you

    Is the NTK POFA-compliant (NEWBIES thread gives a link to Schedule 4, if Google searching hasn't found it, to compare the NTK to paragraph 8).

    Hi Coupon Mad, thanks for your reply. Apologies for the delay in looking at this.
    I’ve reviewed the NTK in comparison to line by line of Paragraph 8 of Schedule 4 of POFA - and it does look compliant. However, I did notice that in ref to Paragraph 8.(7), whereby POFA states that when the notice is given that it must be accompanied by any evidence prescribed under Paragraph 10. The NTK did not arrive with any ‘evidence’ accompanying it such as photos of the vehicle etc - it was just text relating to the PCN. Is there any non compliance in this?

    No because nothing was ever prescribed in para 10.

    Are you certain the NTK has 8(2)f word for word?

    I might have misunderstood your original question when you asked if it complies with Paragraph 8. The NTK references to Paragraph 8, Schedule 4 of POFA and also meets the requirements listed in the Paragraph. However it doesn’t list Paragraph 8(2) word for word in full… if that makes sense?
