They are not exactly lying … but it is extremely misleading because:
- firms can't just 'get a CCJ' but they write this rubbish with scary threats, making it seem as if that can be 'obtained' next;
- even if they tried a small claim, legal costs at this level are capped at £50 and no CCJ is risked if a defendant defends (not even if a person loses at a hearing) because those rare 1% of cases just mean the person pays within the month and LESS than the claim because judges disallow the added £70 fakery;
- The added £70 is unlawful 'double recovery' of the exact same heads of cost that the Beavis case declared must be covered by the £100 PC itself;
- £170 exceeds the 'maximum sum' set by the POFA 2012 Schedule 4;
- no PPC pursuing a single PCN ever applies for an Attachment of Earnings Order nor a Warrant of Control;
- The letter isn't even from a solicitor. We understand it's generated by ZZPS, the debt collector. Disgraced & defunct Wonga were investigated for similar behaviour, albeit QDR are a real law firm whereas Wonga were sending pretend law firm letters AFAIK;
- it's mocked up to look like a final warning before court but it's woefully inadequate, only gives people a very short 14 days (not 30) and fails to meet the pre-action protocol.
Basically it's scaremongering crap, which the MHCLG and CMA should step in and ban this year, given this aggressive debt collection escapes scrutiny by the Financial Conduct Authority which regulates other DRAs.Only in the parking sector can they mislead and intimidate the public like this.

As Coupon_mad says above that QDR letter is a load of crap. It's a bit like the Kray twins without the guns or knives ?
ZZPS might like ti think they can instruct QDR but that is only cloud dreaming as it is NOT their debt, only UKPC can do that
QDR are using the FAKE £70 ADD-ON invented BY OSNER OF ZZPS, MORE UTTER CRAP
QDR are misleading you with that letter and the terrible thing is that many will pay up with the stupid threats they make.
This is not in the interests of consumers and you should make a complaint to the CMA enclosing a copy of that letter asking them to investigate QDR

It's on QDR headed paper and I am aware that this bunch are doing a Wonga and people will pay upon receipt of the letter
The reason this must be reported to the CMA ASAP
This includes ZZPS as it stinks of the WONGA operation
To the OP….. COMPLAIN TO THE CMA, LET THEM INVESTIGATE

The BPA should also be investigated in this mega Wonga style extortion racket

This isn't QDR. It's just their notepaper.
Which is why the OP does NOT report QDR to the CMA. We can't have scattergun rants flying in about the wrong party and without a clear structure as to why the CMA should investigate.

For QDR to allow their letterhead to be used in a Wonga type scam MUST BE REPORTED TO THE CMA because many people will be sucked into the money scam and FAKERY
