    All name or address or other differences in the will need to be referenced. In this case the para 2 declaration might include ‘In said will the said [enter full name] is designed as residing at [will address] a former address.

    You might wish to post a redacted version of your para 2 entry for comment.

    is it ok for the declaration box to say “That I am along with XX residing at XX, the executor-nominate of the deceased conform to her will dated XX which is exhibited, docquetted and signed by me as relative hereto, and that I am the son of the deceased and the said XX is the daughter of the deceased. In said will the said XX is designed as residing at XX a former address.”

    para 2 suggestion looks ok.

    did you establish house ownership?

    yes I did! Turns out it did remain in her ownership so hopefully makes it all more straight forward. Thanks for your help. I am planning to send it off tomorrow. I have a deed extract of the will, I take it I just write the docquett on that?

    You docquet this in the normal way (extract rather than will) but you need to amend the para 2 entry.

    That I am

    along with XX residing at XX, the executor-nominate of the deceased conform to her will dated XX and registered in the Books of Council and Session on the xxxx and of which an extract is exhibited, docquetted and signed by me as relative hereto, and that I am the son of the deceased and the said XX is the daughter of the deceased. In said will the said XX is designed as residing at XX a former address.

    @buddy9 thank you! Might be a stupid question but is it the date the will was signed or the date of extract registration I put in the declaration

    both dates go in.

    Thanks @buddy9 can I hand deliver the c1 form and will to the sheriff court do you know? Should I include a cover letter and do I need to enclose the death cert too?

    The court will accept hand delivery - phone first to establish their process.

    You will need to produce the documents as per the SCTS website.

    A cover note with contact details is useful, the court will phone for card payment when approved.

  • Hi @buddy9, I am woondering, since you have been so helpful to others in various posts, if you would be willing to support me with some questions on the C1 form which I am filling out just now.

    Page 1 - executors - do I need to list just myself or my brother and sister also? they are not applying but they will be getting their split of the estate once all is compelte. Does their details go here too? or just mine?

    Page 2 - Who declares that the deceased - this is fine I just add deceased's name, then in the domiciled in - do I write ' The Sheriffdom of XYZ in Scotland' > (I have been reading other posts and see similar in examples'. Then in section 2 - That I am - what wording can I use here, I am applying for the confirmation (there is no Will) and I am taking on full role and will split with my other 2 siblings once monies are paid out.

    I have other questions :D but will see if you are willing to support first.
