C1 form completion help

I am looking for some help regarding the completion of the c1 form, I naively thought it would be more simple than it is.

Page 1: All ok.
Page 2: Box 1: How do you name the “Sheriffdom” for Glasgow?

Box 2: I am the executor of my mother’s estate along with my sister, could anyone suggest wording for this section? If I am the one completing it does my sister also need to sign at the bottom of the page? Or just be named.

Page 3:
My mother signed her property to my sister and I in 2008 when she bought her flat. However she lived in the property and for all intents and purposes it was hers. My understanding is this is a gift with reservation of benefit and therefore must be included within her estate. Which is fine, I just wanted to know how it would be detailed on the inventory, if at all. Or if it’s included on the valuation in box 23 instead.

She also had a small investment bond portfolio with St James’s place, although she was based in Scotland, her adviser was in London, does this come under personal estate in England?


We have had the flat valued by an estate agent, so I state that it was valued by the name of the estate agent in the description of the inventory?

Page 4: Seems ok.

Page 5: My mother would have inherited my fathers nil rate band when he died in 2002, presumable I tick box 22 as yes?

The estate totals around £482k does this still count as excepted if she also had my fathers nil rate band as well? £650 in total?

    registered office will determine location. Presume therefore an investment portfolio with St James’s Place is personal estate in England

    Page 5:

    ticking box 22? Depends.

    If this is not an excepted estate and IHT400 is required then the instruction is not to complete Q17 to Q25.

    i will need to double check the situation with the gifted property. Assuming i am wrong and it wasn’t gifted, could you glance over my inventory for me?

    Looks ok (for a situation where your mother is the listed owner of the house). You can check ownership for a small fee at Scotlis https://scotlis.ros.gov.uk/ and get the result by email.

    I would see 1 against dwelling house

    2 against royal bank

    3 against household goods

    4 against St James's Place

    Typical docquet format:

    [Place of signing] [date of signing]

    This is the will referred to in my declaration of this date to the inventory of the estate of the late [full name]

    [Signature]

    [Name]

    The docquet should not be on a cover page.

    I have assumed that you have the original will.

    As previous:

    You need to determine the current house ownership to decide whether it is listed in the inventory or not.

    If there is a gift with reservation of benefit then you need to go through the IHT400 process before submitting the C1 to the court.

    And thank you I am in the process of checking the current home ownership. And have noted that I’ll need to do the IHT400 if it’s not in her name.

    The docquet is written on the original will. The original will is submitted to the court along with the C1.

    If you find that you need to submit an IHT400 to HMRC under no circumstances submit the original will to HMRC.

    Hi @buddy9 apologies I have another question. I realised that on the will my sisters (the other executor) address is not her current address. Should I change the declaration on C1 form to state that it’s an old address on the will or does it not matter?
