  • With a development this size it is likely that the developer used the NHBC or Zurich in order to obtain the buyer's ten year guarantee.

    The property is covered by NHBC - I contacted them for a p.o.view and they referered my back to my conveyancer.

    Having first contacted the council I received a response recommending that I seek legal advice in respect of the service provided by my conveyancer?????
    would seem to absolve your solicitors from some of the blame if you accept that they cannot be expected to study two lots of complicated plans which they are not qualified to do.

    This is not a witch hunt!:confused: I am by no means trying to pin blame on an innocent party for financial gain, I just so very desperately want to move.

    We keep seeing these lovely places with a nice little garden (what I'd give for a garden) in the perfect location, at the perfect price and they get snapped up. :cry:

    :confused: All I know is I should not be in this situation and someone needs to take responsibility somewhere along the line.

    Just opened a letter from my lender insisting that I call them within 48hrs (theres a real OR ELSE tone about it) I've tried to call numbers and they're closed.

    Are they going to do something terrible? can they?

    I feel like I'm in trouble but surely not?

    Sit down and relax.
    You are in control.
    You are the one that flagged things up with them - and finally somebody with a brain has read the letter you sent them.

    You are doing all the right things.
    You have done nothing wrong.

    You are one of 13 people caught up in an error not of your making.

    Things are now simply starting to happen.
    This is the start of the ride you've been expecting. And at least for you it has not come as a surprise. Now, imagine if 3-4 other properties in your block also have mortgages with the same company .... they may also have received the same letter and will have NO idea why.

    Just grab that letter and read it joyfully as "finally, somebody with clout is in the game". I am sure it can only be a positive thing.

  • OH MY GOD!!!

    I've spoken to the lender - they have acknolwledged receiving my letter but have advised that this is not the reason they wrote!

    Apparently they do not have a signed offer!!!! I completed in 2005!!!

    They have contacted our solicitor who appears to be ignoring this (suprise, suprise)

    They want to send a copy for me to sign?

    Should I sign this now?

    Don't sign anything until you have talked to your solicitor.

    The bottom line will be that if you don't sign it they will call the mortgage in.

    I can't see why you wouldn't sign the original offer letter. If it were acceptable when you took out the mortgage, why would it not be acceptable now? :confused:

    Surely signing just means that you confirm the original terms as offered? :confused:

    I have just received response to my letter of support to the council,


    Unfortunately, your letter is out of time to be considered by the Planning Officer as he has already written his report in respect of the application.

    However, you will be pleased to hear that the Officer has recommended that the application be approved but this is only a recommendation at this stage. The report will be added to the Circulated Schedule which goes to all Councillors who then have the opportunity to call in the application to be decided at Committee (hopefully this won’t happen!). I think it is unlikely that the application will be called in and then hopefully the formal decision notice approving the application will go out next week.
