  • If, as I understand it, a Breach of Condition has been served, then conditions are being breached - which only become lawful if they've been breached continuously for 10 years. The 4 year rule only applies to new building works, not conditions. ...if that makes sense... !!
  • If you are right and there are a lot in there, you can probably report them to the relevant council department as a HMO. House of Multiple Occupancy. However, if they are all one family it wouldn't be an HMO. They'd have to all be individuals sharing. Google HMO and your Council name to find out more. It might be that your Council insist on issuing a license for an HMO and it has no license.

    Might as well ruin somebody else's day I say :)
    Also, a HMO is not classed as a residential dwelling (if it's more than 6 people living together as one household - doesn't apply if it's one family obviously). Therefore, planning permission would be required to change the use of part of the building to a HMO - although, as the 13th flat seems unlawful anyway, that seems to be a moot point. Worht mentioning to the enforcement officer anyway at the council, as it adds another string to their bow in terms of enforcing the building.
  • Can we sell at a reduced rate, if we give the ful story, that could be attractive to investment buyer right?

    I mean it will get sorted eventually wheter it takes 5 - 10 years it has to come good.

    I just don't have 5-10 years not to be stuck in a 1 bed flat.

    or at auction, do auction properties need HIPs?

    or how about the Barratt homes where they buy your old place?

    Auction would be best bet; you only reveal the minimum necessary and its buyer beware.

    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.

    When buyer's solicitor does search, if he is competent he will discover all the problems you've discovered and that's your sale gone. Even if it was bought at auction, I'd bet the solicitor would find a way out for his client to pull out of purchase and get his deposit back.
