Definitely NOT a fine,  just an invoice from a private parking company  NCP,  to the Registered Keeper,  your dad

As its addressed to him, you dont appeal it,  unless he names you as the driver, his vehicle so currently its his problem as its in his name

Anyone can issue an invoice to another,  so its a legal invoice,  which may be enforceable in law

NCP have no idea that you were the driver,  so wont be suing you,  you are not involved at the moment so won't be receiving any letters, your dad will

He can appeal it using the template in the newbies sticky thread in announcements,  as keeper but not the driver

He can ignore it, but NCP may sue him in the future,  especially if there are multiple invoices for different days

    Name the location

    Thanks, that’s helpful.

I would like to deal with it on my Dad’s behalf, given I was driving the car, and obviously do not want him to get into any legal issues.

No you won't! It is won now, in Dad's name.

I explained how to win and how to easily play spot the difference & check the NTK.
Thanks for the help. I've read through the Newbies Thread (v helpful) and compared the NCP wording in the NTK pics thread.

Just to be clear, the non-POFA wording is in the paragraph beginning 'Please be warned...'? That is the main difference I can see between the example letters regarding 28 days and mine matches the non-POFA letter.

Therefore, should my Dad appeal using the one size fits all template in the Newbies Thread?

    Thanks again.
  • As far as I can see @Coupon-mad is correct the NTK cannot hold the keeper liable.
    Thanks for confirming!

Just for my own clarification, please see Q above as to why it's non-POFA compliant and how my Dad should respond.

    Thanks!

Your dad obviously just appeals saying he wasn't driving and it's non-POFA.

You can find that wording in any Smart Parking thread from LAST year (not 2025) and in the recent Horizon Parking Tesco Hove threads.

Search the forum so we don't have to!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Cheers. So do you think something as simple as this would suffice?

"I am appealing this NTK on the basis that I was not the driver of the vehicle and you have sent a non-POFA NTK, so you therefore have no cause of action against me. Under contract law there is no lawful presumption that the keeper was the driver. This was tested on appeal and the parking firm lost (VCS v Ian Edward)."

    Thanks!

Yeah but you've missed out the usual ending so you aren't saying what you want to happen. You've also not said that he wasn't the driver but won't name them.

"Alternatively, if you intend to reject this appeal and wish to put yourselves to the additional time and expense, you must provide a valid POPLA verification code so that I can refer the matter to independent adjudication."
Remove this as it reads like ChatGPT wrote it. We reckon we can spot AI (laughably wordy) gobbledegook at forty paces!

It looks like you shied away from the usual one line ending, please don't. Just copy.

Haha you got me lol. Hopefully for the final time:

"I am appealing this PCN as the registered keeper of the vehicle.

I was not the driver at the time of the alleged event and you have issued a non-POFA compliant NTK. You therefore have no cause of action against me. I am not obliged to identify the driver and I decline to do so. Under contract law there is no lawful presumption that the keeper was the driver. This was tested on appeal and the parking firm lost (VCS v Ian Edward).

As the NTK does not comply with POFA, I request that you cancel the PCN or provide a POPLA Code if you wish to put yourselves to that time and expense."

    Thanks again!
