Section 75 Credit Card Bathroom fitter

It sounds like there's room for debate about whether it's the product or the installation, which may complicate any attempt to claim against either the retailer or the fitter?Brioni1 said:This is the cause of the leak. Failed cistern groments. He went and replaced them straightaway and stated it was materials. He never charged me. Ive had some plumbers look at it and the majority have said its poor materials and possibly overtighting but should not have failed so soon.0 -
Does the OP have to keep the faulty component as proof of malfunctioning toilet that may have caused the leak as evidence for the house insurance firm if they go down that route?MEM62 said:
In which case you claim on your house insurance for the damage and they, if appropriate, will pursue the manufacturer.Brioni1 said:He visited and found the fault which was a faulty component and replaced it for free with no charge. This component was purchased as part of the toilet so my issue is with the retailer.0 -

Whilst home insurance usually covers damage caused by escape of water - the policy will almost certainly have a blanket exclusion for any damage caused by poor workmanship or poor materials.
So whether the problem was defective gromets, or over-tightening by the plumber, a claim is very unlikely to be accepted by the insurance company.

I will then go down the credit card route and consequential damages0

In the first 6 months as I understand the burden of proof is with the retailer. They should get an independent report at their cost.0

That would be wise.Boohoo said:

Not in my experience. Until we recently retired my wife was a partner in a bathroom supply and installation business. On the odd occasion that there was an issue, for whatever reason, the fix was done under their guarantee and any consequential damage was claimed for from the customer's house insurance policy. That is what it is there for. The insurance company would pursue a third party if they thought there was negligence but this would only be in the case with large claims.eddddy said:MEM62 said:

I need some advice on where to go with a bathroom situation. I got a new bathroom fitted about 8 months ago. I supplied the suite etc and tiles. After about a month the Gromets under the toilet perished and caused a minor leak in the ceiling. The fitter returned and replace the gromets. He blamed this on the quality of the components. The suppliers have stated its down to over tightening. 3 other plumbers have said this also and I have the original gromets. However I gave him the benefit of the doubt. Recently I have just noticed that the tiles on the stud wall part of wall plane are tenting and the grout is cracking. I have been told this down to expansion and sealant needs to be used. ( I asked about this and he said he does not what it is ) He is happy to do this. I am getting a feeling of poor workmanship. I took photos of when the stud wall was built and showed them to a colleague of mine recently where the installer had used grey plasterboard. When I asked the fitter if the substrate was water proofed he said it was. I have this in any email but don't know what to look for as I am not experienced. It just looks like plasterboard to me. I am worried that there appears to be a theme regarding his work. I have paid by credit card and have a 12 month guarantee from him but am loosing confidence. I am considering giving him another chance but id their are anymore incidents invoking a section 75 claim. Can anyone make any suggestions please ?

When you say you paid on CC just what exactly & who did you pay via that means?
Given you bought the goods & they fitted them.
