Section 75 Credit Card Bathroom fitter

That's not really true though for s75 (although it is for chargeback, where the card schemes define the rules) - the law simply holds the creditor jointly liable without there being any prerequisites for making a claim, although as you say, claiming breach of contract inevitably requires evidence of that contract and its conduct.born_again said:So what have you & or the person done to resolve the issue.
You can not just go to your CC for a S75 claim without evidence of trying to resolve, proof of costs to resolve & most important T/C of contract to prove breach of contract &/or misrepresentation.
Having said that, it will generally be in the customer's interests to try to resolve the matter with the supplier before launching a s75 claim, but the point is that it's not necessary as such:https://www.moneysavingexpert.com/reclaim/section75-protect-your-purchases/#howHow do I make a Section 75 claim?
The law makes clear that both retailer and credit card company are jointly responsible for Section 75 claims.
It might be easier to first complain to the retailer in some instances – for example if you're looking for a repair or a replacement rather than a refund – but you don't have to.

This seems a massive overreaction to an issue that is being sorted by the fitter. “It stared with a leak…” - and what else, given you’ve not actually mentioned anything?0

Sorry if i have been vague and not clear. To be fair the fitter has been very reasonable. He visited and found the fault which was a faulty component and replaced it for free with no charge. This component was purchased as part of the toilet so my issue is with the retailer. I purcharsed the toilet 2 months ago. The issue is with the leak that has caused damage to the ceiling and consequential losses.

This is the cause of the leak. Failed cistern groments. He went and replaced them straightaway and stated it was materials. He never charged me. Ive had some plumbers look at it and the majority have said its poor materials and possibly overtighting but should not have failed so soon.0

In which case you claim on your house insurance for the damage and they, if appropriate, will pursue the manufacturer.Brioni1 said:He visited and found the fault which was a faulty component and replaced it for free with no charge.
