    Hey
    So I just had my mediation call
    There was some back and forth as I was hoping to settle without the need for further fuss. This is pretty much how it went in terms of offers:
    Them: £190
    Me: £10
    Them: £100
    Me: £15
    Them: £60
    Me: £30 no more
    Not settled
    What do you think of the above? In hindsight I wish I didnt budge from the initial £10 offer.
    Do I just wait to hear from the court now?

    Yes await the court order from your local civil court that you nominated in your N180 DQ document, in a month or two

    Hi all,

    I'm starting to prepare my Witness statement

    I received the Small Claims hearing letter and date. Claimant has until 4pm today to submit their documents but I am yet to receive an email.. can I cite this requesting their evidence submitted afterwards to be struck out?

    I have photo and video evidence of the parking signage covered in graffiti so planned the reference the Beavis case

    On my PoC point 3 mentions a breach due to parking without displaying a valid ticket. I thought to reference Chan or Akande cases as the ticket was valid but the car overstayed

    I wasn't the driver but im not sure how I am able to add/prove this?

    I have the initial NTK which only showed 2 PCN (both paid for) then on challenging they emailed me and imagine showing a third pcn not secured properly - I was intending to cite the BPA code breach as I was unable to appeal

    Im thinking of adding in babys hospital discharge letter to show the stress at the time - and also how they failed to respond to my complaints... not sure how much this would be taken into account!

    Could you please advise on the above if these seem sufficient/valid for my evidence

    Your deadline is the same deadline as their deadline

    More importantly, what was the hearing fee deadline date. ?

    Check your email inbox and spam folders for their N279 discontinuation document, because its likely that they have failed to pay the hearing fee and have discontinued, same as the other 927 cases in the discontinuations thread by Umkomaas

    Hi - The letters states the deadline for defendent to submit is 14 days before the court date (1st Sept). The hearing fee deadline date was 4th Aug. I have checked by inbox and spam and nothing received so far

    Phone the court tomorrow morning and see if they actually paid the hearing fee, or is the case struck out due to non payment

    Doubt they paid the fee.

    Email DCB Legal saying you believe they failed to pay the hearing fee so you will claim your costs on the indemnity basis, if they fail to email a copy of their Notice of Discontinuance to end the case.
