dcb legal and secure parking solutions

Hello I'd appreciate some help please

My car was parking in a pay &display near a hospital (car park not owned by hospital). Paid for a 1 week stay and ended up overstaying due to requiring an unexpected life-saving operation
2 PCN were attached to the car - appealed these, lost and paid for the anyway.
Received a notice to keeper claiming a 3rd PCN was issue (not attached to the car!!!)
Wrote a letter to secure parking solutions explaining the situation (explained it would be illogical to ignore the third pcn). Requested to appeal as it was outside of the 28 day period - not my fault as I did not get the windscreen pcn - they did not respond
Wrote a complain letter to them - again no response
Attached copy of hospital discharge letter, proof of the other 2 PCN paid.
Received 2 dcbl letters  - ignored
Now have received dcbl legal letter of claim
Could you advise on the action to take please?

    Study the Letter of Claim advice given by coupon mad in post 2 in announcements near the top of the forum

    I have just read through that, but they did not give me any reply forms mentioned in the post. 
    Would I be correct in emailing the response directly to info@dcblegal.co.uk, I couldn't find an alternate email.

  • Hello, so in that email I added at the end:

    "Secure Parking Solutions Ltd failed to affix PCN Xxxxx to the vehicle, subsequently this was not received by the driver thereby denying the motorist an opportunity to appeal or pay a reduced rate.
    A formal complaint has already been submitted to Secure Parking Solutions, who have failed to respond. This has been escalated further due to breaches of the BPA code."

    DCBLegal responded by email saying 

    "We write to acknowledge safe receipt of your formal response to our Letter of Claim sent to you in respect of this matter.

    Having considered your response, our position in respect of this matter remains as per our Letter of Claim. We note that despite your points of dispute, there is an absence of any evidence in support of the same so that we may consider this with our Client. If you do have evidence which you believe supports your dispute, please furnish us with the same within the 30 days afforded to you.

    As it stands, the initial 30 day timeframe under the Pre-Action Protocol remains, and County Court proceedings will be issued following expiry of this 30 day period, without any further reference to you.

    We strongly recommend that you contact a member of our dispute resolution team on 0203 838 7038, as a matter of urgency so we may discuss this matter with you and avoid a Claim being issued against you.

    If you are at all unsure of your legal position, you may wish to seek independent legal advice"


    Could you please advise on the next steps to take?

    No it's pointless. DCB Legal don't listen to anything. Wait for the claim form which is 100% what you want!
