Good afternoon
I received a money claim in the post today, please see attached.
I'm unsure of how to proceed and whether or not I should be completing an acknowledgement of service as the letter states to do so if you disagree with the claim.
The parking ticket had expired so the vehicle would have been parked without a valid pay and display. However I have already paid the 2 PCN charges that were affixed to the vehicle. This claim is for a third PCN which was not attached on collection.
Would I therefore need to follow the guidance for 'if you admit only part of the claim'

I've been reading through the post - I was unsure if I needed to complete the AoS as the 'if you admit only part of the claim' does not mention doing so?
I assume as the vehicle was parked without a valid ticket then part of the claim is correct. Therefore I wouldn't be following the 'if you disagree with the claim' section.

I know what you mean but your defence refutes the Poc, the POC doesn't mention what you say, regardless of what actually happened, plus they added spurious charges too
It did have a valid ticket, which expired, so insufficient paid time, not no ticket !
Complete the AOS online next Tuesday or later

I've completed the AoS today
With regards to the defence, I intend to use points 1-10 as per the template defence (word for word if that's okay!)
What are your thoughts on my section 2 and 3 please? Thank you2. The allegation(s) and heads of cost are vague and liability is denied for the sum claimed, or at all. At the very least, interest should be disallowed; the delay in bringing proceedings lies with the Claimant. This also makes retrieving material documents/evidence difficult, which is highly prejudicial. The Defendant (D) seeks fixed costs (CPR 27.14) and a finding of unreasonable conduct and further costs (CPR 46.5). The Defendant has little recollection of events and has little to add other than admitting that they were the registered keeper, not the driver, bringing into question whether the Notice to Keeper was POFA compliant.
3. Contrary to the POC, the defendant did not receive a PC on 14/07/2025. The defendant made attempts via email and post to contact the claimant in a bid to resolve the matter, also providing evidence of exceptional circumstances. Failure of C to correctly and securely issue the PC, meant that the defendant was denied the opportunity to appeal the PC or pay a discounted rate, thereby violating the BPA code of practice 8.4.1c which C must adhere to. Two separate PC were issued by C on 12/07/2025 and 13/07/2025, which were received by the defendant, who paid a total sum of £80 due to failed appeals. The defendant was not the driver and was a passenger taking their newborn baby into hospital for life-saving surgery so was in an exceptionally emotive state. The defendant’s vehicle did in fact display a valid pay and display ticket, however due to the unpredictable and stressful situation, which resulted in a 4-week stay at Birmingham Children’s hospital – the ticket expired. The defendant wrote a complaint letter to C but the complaint was not acknowledged.

Important to note that the accusation is "parked without displaying".
It is not an accusation of overstaying paid for time, or insufficient payment, so don't respond to an accusation they have not pleaded.
You need to say a lot less. Do not mention getting 2 PCNs or paying £80. Simply deny that the driver failed to display and put the Claimant to strict proof of their allegations and full compliance with Schedule 4 of the POFA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The Claimant is put to strict proof of their allegation and full compliance with Schedule 4 of the POFA. The defendant wrote a complaint letter to C but the complaint was not acknowledged.
