Disputed Parking Charge Britannia Parking Represented by BW Legal

Good afternoon,

I am new to this forum, drawn to it by some of the amazing support for such disputes.

The original Parking charge was Issued back from 12/02/2023. I don't know if a brief description of what happened is needed, however after certain circumstances it became apparent that playing hardball was our only option. I say 'our' as the vehicle is registered in my Wife's name but I am acting as her representative on MCOL. We have had no contact with them until the Claim form was sent on the 22/09/25.

I have filed acknowledgment of Service on MCOL and receipt of this was given as 4/11/25.

So I am asking for a little support in filing the defence and have registered myself as her litigation friend on MCOL.

Trying to navigate this forum, I think I have found the template and I am currently putting it together.
Is it to post on here without any personal information so as, to make sure I have it in the correct order?

  • While I have found the template, I am having a little difficulty with Para 3.

    The particulars of this incident were :

    It was a car park associated with a public house.
    It was early evening Mid-Winter dark, cold and obviously wet (being England)
    We have 3 children and a dog in tow.
    We do not see any signs
    The Pub was extremely busy.
    Nobody mentioned entering Vehicle details.
    Food was delayed and we spent nearly 3 hours in there.
    Alleged breach of contract.
    Contacted Pub after initial Parking charge and was told it would be sorted.
    Reminder came through and spoke to the Pub again, was assured it would be sorted.
    Time to appeal lapsed and have played hardball ever since until claim form was sent.

    Would it help if I put the POC up on this thread?

    Would really appreciate any advice with this defence.

    There is something wrong with your dates!  If the date of issue of the claim form was 22/09/25 the AoS was due on 11/10/25 and your defence due on 27/10/25 so I don't see how the AoS was acknowledged when you state on 04/11/25.  If you meant October not September then: -
    With an issue date of 22/10/25 and having completed the AoS in a timely manner your defence deadline date is 4.00 p.m. on 24/11/25
