A shame the driver and the defendant aren't different people.
Your wife was driver and keeper right?2 -
It says to be completed by or on behalf of. So She is listed as the very beginning as the D. Then should I continue with D details? I assumed it would be mine as I'm completing the form on D behalf.? Then the form be signed by the D
I will also be the one attending the mediation appointment.0 -
The Driver and The defendant are different people. There has been no discussion and they have no knowledge or proof of who was driving. We have only accepted the D was the Registered keeper.Car1980 said:A shame the driver and the defendant aren't different people.

You don't put your details anywhere except to take the daft 5 minute phone call, if she can't.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Right, so they have not brought their claim under POFA and have even boxed themselves in by specifically claiming against the driver only.flooredDesign said:

Your wife was driver and keeper right? In theory your defence could just have been two or three lines.2 -
Good evening,
It has been a while since I was last on here.
Unfortunately we have moved onto
HEARINGS - WITNESS STATEMENT AND EVIDENCE TIME!We have a hearing date, The date given on page two is 30/06/26. The deadline I have to file the evidence ('exhibits') and Witness Statement is 29/05/26.
My wife is the D. I am a witness. We will both make a statement to file. I am however slightly confused by some of the other points we should file as our defense. I'll get round to this but firstly.
My wife suffers from Anxiety and ADHD. I would be her representative in Court. Does she need to attend court or can I represent her without her being present as a Lay Representative. If so do I need to fill out any forms for this role?

She must attend the hearing
The Defence is already written and on file, so no defence can be submitted now
You cannot file anything
If you are a Witness, you cannot be her lay representative

Ok so she must attend the hearing.
The defense was submitted at the beginning.
Surely we must submit witness statements and any other evidence we may have to help our case?
So if I submit a WS I cannot be her L R. If I do not produce a WS can I be the LR?

She, as the defendant, submits her WS plus Exhibits bundle, as ordered in the court order with the hearing date on it ( you can help her to do so. , there is no WE. , its HER case. )
AFAIK, its one or the other, the operative word being Lay
