CCJ from old parking ticket, what should I do?

    2. The allegation(s) and heads of cost are vague and liability is denied for the sum claimed, or at all. At the very least, interest should be disallowed; the delay in bringing proceedings lies with the Claimant. This also makes retrieving material documents/evidence difficult, which is highly prejudicial. The Defendant seeks fixed costs (CPR 27.14) and a finding of unreasonable conduct and further costs (CPR 46.5). The Defendant has little recollection of events, save as set out below and to admit that they were the registered keeper and driver.

    Referring to the Particulars of Claim, paragraph 1 is denied. The Defendant is not indebted to the Claimant. Although the Defendant is the registered keeper, paragraphs 3 and 4 are denied. The Defendant is not liable and has been provided with no evidence of any breach of clear or prominent terms. The Defendant denies the claim in its entirety. Any stay at Bow Wharf London, would have been verbally agreed in advanced with the management of Regents Lake Banqueting Venue. Given the passage of more than four years and the lack of detail in the inadequate Particulars of Claim, it is impossible for the Defendant to provide a full response. Signage at the material time may also have been unclear or insufficient. The claimed sum is grossly inflated, as no private parking charge can lawfully amount to £170, and no loss or damages were incurred.

    The thread today that is a Smart Parking group thread, to stop us having to reply on hundreds of Smart Parking court claim threads that are all essentially the same, and don't need individually checked defences because these cases are a cinch.

    And we were drowning in them.

    I don't need to link it. Look around. Today's posts are only on the first 3 pages right now and there is only one called Smart Parking claim via DCB Legal? Group info thread.

    And it's on page one right now... so you'll be there reading it in 2 minutes flat.

    See you in 2026 when your claim gets discontinued in the end!

    Thanks, had a read of it. 
    From what I understand, there's no need to personalise para 3 anymore? You just copy/paste the template thread replacing para 3, 4, and 4a with those listed in the DCB group thread?

    Correct, use that adaptation in the group thread,  save the stories for next year 

    Note, paragraph 2 stays as is, ending in keeper,  same as the template

    Can I suggest the whole template with the amendments just be posted on the Group Thread?

    Reason I ask is because now it's getting confusing on what para 4 to use. 
    Para 4 and 4.1 are not on the original template. The para 4 on the template is very different to the para 4 on the Group Thread.

    OK... maybe... when I get time.

    I hear you & I'm listening but after well over a hundred exact same "Help, I've got a claim from DCB Legal/Smart Parking" threads replied on with the exact same standard advice, day after day after week after month this year, I now feel "all Smarted out"!

    Personally, I really hate templates on this board. They are a bugbear of mine. I think template complaints and dispute wording set up word for word can make people lazy and it certainly loses effect which isn't a good thing. The defence template goes against the grain for me. I was really reluctant but needs must.

    I do already tell people in the Smart Group thread to "renumber the paras and they'll have 11 altogether". I also give a link to the Template Defence which is something I never normally do because posters should read the NEWBIES thread before posting and everyone can find the template in seconds as it's pinned at the top of the forum anyway.

    Just a thought: any poster could post the full defence there. Doesn't have to be me!
