Smart Parking - HELP! have received count court letter - advice greatly appreciated

hi guys, I have some experience in challenging parking tickets and charges but my wife has in an advanced stage and has now received County Court paperwork, instigated by Smart Parking. Does anyone have any experience of this? Is it wise to challenge this or even to go to court (am thinking yes and no).  many thanks for any ideas or any help

Hundreds of similar cases on here,  so study the announcements at the top of the forum,  newbies thread plus defence template thread

The defendant named on the paperwork must defend,  like the advice in this thread for example

Can you show us the Claim form, first having redacted (covered up) personal information and the QR code but leave the date of issue showing.

If it is (as I expect) DCB Legal fronting Smart's grab on your wife's purse, please add the following thread to your reading list, because as long as you and your wife follow court protocol and forum advice, her case will be recorded there sometime around Spring next year.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

do you guys think DCB Law will drop the case if defendants simply show they will take it to court? or do they have to show a good defence in the appopriate box on the Small Claims website

They won't drop it until sometime next year,  just before the hearing fee deadline date,  so in 6 to 12 months time,  so long after you complete all the CNBC instructions from us, the defence is irrelevant to them, but has to be as good as it gets for you

Most of your Defence is written for you in the craftily named 'Template Defence' Announcement (one of the first 5 at the top of the forum thread list). You just need to construct para 3 which outlines the circumstances of your parking event.

Go through the necessary motions, DCB Legal will discontinue later next year. Patience needed, there's no shortcut (well, none that we'd recommend!).

your very kind to help.So sorry, what are the CNBC instruction?  Do you think they will drop it if we say we are going to a hearing? no worries if you don't know. (we dont really have any defence - am going to have think of one, but as you said, the content of the defence may not matter)?
