Claim Form - DCB Legal - Smart Parking Ltd
OldPippyCat
Hi, and thanks in advance for any help.
i have received a claim form for DCB legal/Smart Parking Limited.
I have submitted an AOS today (4/11/25) as advised in the Newbie section. I am now unsure of what to do? I thought it would be as simple as replying with a short defence of facts but it seems not, and I’m struggling reading/understanding all posts on here.
FACTS
parked in a multi story car park, which has a barrier, gives you a ticket, you pay for your parking before exiting & barrier lifts.
I paid for parking, barrier lifted & I exited.
I have proof of paid amount in bank statements.
There is also many reviews online of this happening to a few people.
I park in this car park semi regular. It has never happened before/again.
Infact, the barrier is now always open & parking is done through registration with no physical ticket given.
Please see particulars below.
Any guidance is much appreciated.

I will add, the first I new about this PCN was a few months ago when I received an intent to claim.0

Missing paperwork is no defence , happens all the time when people move and don't tell the dvla promptly, or at all
Same advice as in this Smart Parking thread below, although your POC is about Insufficient payment
https://forums.moneysavingexpert.com/discussion/6637757/court-claim-form-received-how-to-respond#latest
Post the Issue date from the top right of the claim form below, because you failed to mention that crucial date1 -
I was not clear. The missing paperwork isn’t my defence. The fact I paid the amount shown on the machine and the barrier lifted to let me exit, is my defence.
I was explaining I’d heard nothing previous incase people wondered why I haven’t appealed before it got to this stage.
The issue date 29/10/2025
AOS submitted 4/11/20250 -
Save all that for your Witness Statement bundle next year, you are drafting your defence based on recently approved defences to a similar claim. Your WS bundle can say all what you have said so fat, but isn't needed for 6 to 12 months
The basic defence is theoretically, not guilty
Look at a few others over the last week and adapt a close match, rebutting the claim, nothing to do with the circumstances, just the correct legal defence, where the driver made full payment demanded by the machine1 -
I’m not sure if I understand

This is what I think you are saying.
copy and paste all 1-8 of what coupon mad has wrote but for number 3 put ‘The driver made full payment as requested by the machine’Then submit it.
IF it goes to court, I then prepare witness statement & provide proof of payment etc. There is a lot of jargon (and words) in posts, so not sure what is & isn’t relevant to me.0 -
Does not matter if you don't understand it all, presumably you have no legal training ( neither do I, you haven't defended a claim before ( neither have I )
We will check your 10 to 12 paragraph draft defence for you, to eliminate issues or mistakes etc
The current template defence is actually 10 paragraphs, not 8 , but yours will have one or two extra paragraphs added as well
We want you to post it on here first, you only submit it when it's approved, so it's like having your homework checked, a back to school scenario
Nobody said it will go to court, there isn't any court allocated yet, no pencilled in slot either, no court fee paid
The WS plus Exhibits bundle stage is a few weeks before the pencilled in date, so before, not after
This will be discontinued before the hearing fee deadline date, same as hundreds of other cases on here
Just do what we tell you, even if it feels like you are back at school, the teachers know, the sheep in the class learn as they go, the end of the day bell is a long way away, typically around summer or autumn next year, so strap in2 -
With an issue date of 29/10/25 and having completed the AoS in a timely manner your defence deadline date is 4.00 p.m. on 01/12/25 1 -
If you never appealed it, i would base my defence on no keeper liability1
-
Yes. Why isn't the OP just copying another Smart Parking defence with the extra paragraph 4 added about the POFA untruth? Hundreds here, already written and waiting to be copied. It's soooo easy!ChirpyChicken said:If you never appealed it, i would base my defence on no keeper liabilityPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
