Can I just check that the letter is definitely in your name (not that of the lease company)?tonythetigeruk78 said:Ok, will send them the airport appeal letter and see what happens. ThanksPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Yeah, this letter has now come direct to me and is addressed to me. Although, under the contravention details, it says notice is hereby given to the hirer of the vehicle.2

Thanks for confirming, just the job! So use the standard appeal (but use the term 'hirer' rather than 'registered keeper'), then please let us know that the charge has been cancelled in a few days' time. Getting confirmation that our advice continues to work is essential to having the confidence to advise others in future. 👍tonythetigeruk78 said:Yeah, this letter has now come direct to me and is addressed to me. Although, under the contravention details, it says notice is hereby given to the hirer of the vehicle. This is an appeal by the registered keeper - No driver details will *ever* be given. Please do not bother with your known fishing expedition in an attempt to get driver details. It is known parking firms do this to try and get around the fact when there is no keeper liability in play. (and never can be under POFA)Due to this being airport land you will be well aware there is NO keeper liability due to the byelaws in force and thus not relevant land.As there is NO keeper liability then liability cannot flow from the driver to the keeper and thus is an auto win @ POPLA. Please therefore cancel the notice or issue a POPLA code where you will auto withdrawIf you waste your time asking for driver details this will be ignored and you will still lose at POPLA if you dont cancel the PCNSo let's save my time and yours and cancel this PCN you simply cannot win this (and you know it)
that is the standard text for keeper appeals3 -
That exact wording is still ok, even though the taxi leasing company have already identified me as the driver?0

I'm a little confused as a previous reply on my post, by another person, states to use the standard appeal letter, changing the registered keeper to hirer0
-
Leasing company can only identify you as the hirer/keeper unless they were sat next to you when you were driving. Just change the wording "Registered Keeper" to "Hirer"tonythetigeruk78 said:That exact wording is still ok, even though the taxi leasing company have already identified me as the driver?1 -
Thanks for the clarification.0
