Yes - but don't offer three figures.

TCP cases do go to hearings though, I seem to recall. Not discontinued. So I see why you are giving it some thought.

Mediation stage , yes, its about reaching a monetary settlement, so if you dont want to go towards a hearing, offer say £5 or £10, starting low, some cases can be settled fairly cheaply, at say £20 or £30

Do not go up in increments higher than £10 a time and stop if it gets past £60. Say no.

And DON'T be bullied by the Mediator. The case will not go on for a year and you are not being unreasonable if you end the mediation process without settling. It's your call.

Hello, so I did this and got letter that it will be taken to court, DCB them told me if you want to settle out of court to let them know and I did not respond as I thought it was last minute tactics.

They now sent me a letter with their witness statement and that claim has been filed with court. Hearing is 19th June at 00.00 which is a bit odd as this is the first I hear of it and it's at mindnight!

I have no idea what to do now.

got letter that it will be taken to court,

Who was that letter from? Was it a Notice of Allocation? It is worrying if you haven't received a NoA with the claimant stating hearing is 19th June, the normal deadline for witness statement is 14 days before hearing date.

You do know what to do. I gave you the heads up that you'd have to prepare for a hearing.

So, after mediation failed, you should have revisited the NEWBIES main resource thread post 2 to read about this stage & started to prepare your evidence. Now you are in a rush to catch up, but it is easily sorted.

As I said 3 months ago:

"TCP cases do go to hearings though, I seem to recall. Not discontinued."

So you knew this stage would come and the NEWBIES thread tells you about witness statement stage. You had the same deadline as DCB Legal did, so it is URGENT to get this done and email your WS & evidence to the local court and DCB Legal tomorrow.

Once you have got that bundle emailed off (Monday), THEN on Tuesday ring the local court to ask the time of your hearing. Note it.

On the day, turn up with copies of both sides' bundles, half an hour early to get past court security and sign in / grab water, etc.

No notice of allocation was sent, the only thing I got was notice of proposed allocation back in Nov 2025. The first I hear of a hearing is when DCB sent me their witness statement. Can a hearing be at 00:00? this was the time they said it was on
