Hi all,

 

I received a County Court Claim Form from the Civil National Business Centre, issued on 18/9/2025. The Claimants are Total Car Parks Ltd. The claim is being handled by DCB Legal. This is the second letter from CNBC but for a different fine/claimant within a few days. 


Particulars of Claim (Total Car Parks):

1- The Defendant (D) is indebted to the Claimant (C) for a Parking Charge(s) (PC) issued to vehicle XXXXXXX at Park Place, Manchester, M4 4EY.

2- The date of contravention is 01/05/2025 and the D was issued with PC(s) by the Claimant.

3- The Defendant is pursued as the driver of the vehicle for breach of the terms on the signs (the contract). Reason: Parked Without A Valid Parking Session.

4- In the alternative the Defendant is pursued as the keeper pursuant to POFA 2012, Schedule 4.

AND THE CLAIMANT CLAIMS

  1. £160.00 being the total of the PC(s) and damages.
  2. Interest at a rate of 8.00% per annum pursuant to s.69 of the County Courts Act 1984 from the date hereof at a daily rate of £0.02 until judgment or sooner payment.
  3. Costs and court fees.

Background(Total Car Parks)
I think for this one I tried to pay but the app kept freezing and I was in a rush so I went to where I needed to be and the machine was not actually working. Can I put this as my argument?


I’ve already filed an Acknowledgment of Service online for both

    With an issue date of 18/09/25 and having completed the AoS in a timely manner
    your defence deadline date is 4.00 p.m. on 21/10/25
    Is the issue date of your second claim form the same as this one (18/09/25)

    I have this for paragraph 3,

     
    The Defendant avers that any alleged contravention did not occur. The payment machine at the site was out of order at the material time, and the Claimant’s mobile application repeatedly crashed and failed to process payment despite multiple attempts. The Defendant made every reasonable effort to comply with the purported terms but was prevented from doing so by the Claimant’s own system failures. Having been unable to make payment, the Defendant promptly left the site and parked elsewhere. In these circumstances, no contract could have been formed, and any purported breach is denied. The Claimant is put to strict proof that its payment infrastructure was fully operational and accessible to users at the relevant time.


    Is this sufficient enough?

    Who signed the claim form  -  on the back?

    There is a signature of the person who issued the claim form,  either bottom left of the claim form or its on the back near the top of the claim form,  typically it's signed by a person with the initials S.E.
  • Yes it's signed by S.E. Does this affect anything?
