I'm not 100% convinced the plan is accurate, beyond showing the approximate location of the general boundary.  It wouldn't surprise me if it turned out the true legal boundary was the low wall next to the drive of the property the OP is looking at, if that lines up with the garage wall.  Or else somewhere between the two.

I definitely wouldn't be complaining to the neighbour about their encroaching flue until I'd done more research.

thanks conveyancing team has confirmed that the land between garage and neighbours wall belongs to this house, which is nearly a metre wide but covered with foliage, we would wish to have a path there for bins etc
but that prominent flue is nearly 75 cm , more than half way  architect is hedging his bets about what would be the boundary in terms of planning an extension ie 2 met from flu or the wall
