Need help with knowing boundaries of property we are buying

Hi in process if conveyancing,  got sent land registry  etc by solicitors 
Confused as I notice a large flue like thing from.neighbours wall  and it appears it's atleast 50 cm or more overhanging  on the side we are considering  an extension  over garage
Where would planners calculations  be from?

    Would a builder be able to give you an idea if it's going to be a problem?

    Meanwhile  - you might want to crop your photo a bit as there seems to be some personal bits at the bottom.

    Hi,

    As Brie has noted, you need to crop.that photo.

    The boundary is as marked on the Land Registry plan assuming that that is consistent with what is present on the ground.

    If the two are not consistent then you need to get clarity from the seller as to why they are different and seek the advice of your solicitor as to the consequences.

    Are you sure that the flue does overhang the boundary - how is the boundary marked in general?  Are the bushes in the photo part of what you are buying or the neighbours?

    It is very difficult to relate the photo to the Land Regustry plan - is the photo from somewhere in the top right of the plan?

    Builder and architect  both mentioned that flue may be on our side of boundary 
    Acc to them the hedge should be ours giving us nearly  a metre room to inset second floor extension but have also asked  solicitors  who jave just sent the documents again

    But won't you be leaving a gap between the properties?

    The problem with LR title plans is sometimes the red line a quite wide, as is yours.
    Scaled up to real size i have seen boundarys up to 3 feet wide and caused massive problems.

    OK, I'm confused. 

    You want to build an extension over your garage, yes? But the flue doesn't project over the top of that, does it?

    So while there may be issues surrounding where the boundary actually is, which could be a problem in itself, how does it affect the the extension? Or are you knocking down the garage, and building to your property line?

    Your conveyancing solicitor, hasn't seen the property, so cannot tell you where the boundary is on the ground, except for supplying the documents you have. 

    Speak to the seller, and the neighbour, and you might need a boundary surveyor.

    Who planted the hedge? That's who owns the hedge. It may have been a joint effort, planting along the boundary, it may not.

    extension question was only because we have been told we may need to inset first floor extension by either 2 or  4 metres( from the flue or neighbours wall was my question)
    seller is in care home, sale is by power of attorney and they havent been able to tell us about the hedgesBaldytyke88 said:

    yes, question was how much  in the area acceptance has varied between 1 metre to 4 metre required

    Who is telling you the inset is 2 or 4 meters? Is it the builder or architect (edited as I'd just seen you'd mentioned them)? Why don't they know if it's from the flue or the wall? Or maybe even from the boundary? 

    Is this to do with what you can do under permitted development, vs getting planning? 

     Is there anything on the local authority's, planning permission website, that gives you an idea? 

    OK, so you can't ask your seller about the hedge, but can you ask the neighbours? And try to establish where they think the boundary is? And see if you agree.

    And what's between the garage and next door? Is it all just hedge, some fencing, or is there a path or something along there too? Especially around the base of next door's walls? 

    Otherwise, it's pretty much a bunch of people on the internet, guessing things. Eek.
