Private Road, Abandoned Car, SORN and ownership query

    Thank you for your answers MM, I was typing at the same time.  I'll try to stick with the terminology and not use "ownership" but be more specific at this meeting.  
    There is a management company but guess who one of the directors is?  I'm just a shareholder paying to maintain a road with an eyesore whilst still paying council tax, car tax etc for a slightly limited council service. 
    Local journo wants to run the story but I fear the consequences for my family.  It's a well-known family locally, if you catch my drift. 🙁

    I'm just a shareholder paying to maintain a road with an eyesore whilst still paying council tax, car tax etc for a slightly limited council service. 
    Which you knew to be the case when you bought the property...

    True, but I wasn't aware of the "neighbour".  The car arrived after we'd bought the house and lived here for a couple of years.
    We did accept the Council Tax/Estate Rent Charge overlap, but I had no idea that the set of council services or police powers would be unavailable to us in these circumstances.  It's difficult to appreciate how a couple of metres away, on the same private road's main drag, the road traffic acts etc would apply.  I'm not asking for a C Tax refund for unavailable services, but I take onboard the point that we might have to approach the land owner/management company again.
    The question of whether we should disclose the car's presence to potential buyers if we were to sell, isn't in  question because it's hard to miss, so we aren't planning to try to sell until it's gone.  Considering the neighbour wants us to leave he's kiboshed that for now.

    It sounds like you need a local "scote" to take the car for a joy ride and abandon it somewhere else.

    So what do the other ‘Directors’ say ? Are they residents ? Are they impacted ? Or do they just accept ?

    The Road Traffic Act applies everywhere. That is what you are looking at in deciding this car is present illegally on a public right of way.

    It is just that it is not reasonable or realistic - especially after the last decade and a half of Westminster gutting of local authority funding - to expect the local authority to be responsible for clearing up private land.

    Your beef here is not with the public authorities, but with the company you pay to manage the private land.

    Nothing to do with the Road Traffic Act.

    Trust me, I'm tempted to offer it free to a good home on Facebook but the neighbour is very litigious 
    What would they be suing for? The value of the car? Which is currently what?

    So V5.
    So Op could given mention of person not updating V5 request change of V5 to them & then scrap car & keep profit.

    Or they could advise them that either it gets moved or someone will do the above.

    Nothing to do with the Road Traffic Act.

    "public road" here means a road accessible to the public, not one paid for by the council?

    You couldn't leave a SORN car in an Asda carpark as it's deemed a public road, so it sounds like this would apply.
