  • As the clamp is only on the wheel I am wondering if, for now, I can remove the wheel and use a spare tyre, so I can take my son to his medical appointments.

    However, If I am driving round in the car until the debt is settled will it be classed as stolen as the debt enforcement agency stated the car is now in possession of the bailiff?

    Jacobs are bailiffs who do act for councils.

    Get your local MP to immediately complain to the council and Jacobs to point out that the reduced road tax is evidence that this car is primarily used by a Blue Badge holder and the clamp must be removed.

    I own the car.
    If it's your car, but your spouse's debt, I can't see how the bailiff can seize it?

    Apologies, the fine is in my name as I am the registered keeper, but it was my former spouse's act.

    The law seems to state that the rule of applying the debt to the registered keepers vehicle, applies with PCNs issues by a local council but not fixed penalty notices?

    Former spouse even tried to swap it to his name but the local authority were having none of it.

    The local authority was right. It is the owner who is liable for penalty charge notices, not the driver.

    Complain to your MP and the ECB because the car seems to be Motability?

    Why didn't your ex just give you the money to pay it?

    Surely if they were willing to have the debt transferred, then they would be able to give you the money to pay instead?
