Blue badge holders car clamped on drive

My car was clamped by an enforcement agency. It is our only vehicle. My son is registered as disabled, has a blue badge and is living at the property. Blue badge was not displayed at time of clamping. The car has a 50% reduction in road tax due to my son being in receipt of personal independence payment.

Contacted enforcement agency who stated it is now between me and the bailiff. 

Citizens advice state that the car cannot be taken if it has a blue badge 

"When bailiffs can’t take your vehicle

Bailiffs can’t clamp or remove your vehicle if you can prove:

  • it has a valid Blue Badge or is a Motability vehicle"


The bailiff has since text and stated under no circumstances will the clamp be removed unless he receives payment.

Already had to cancel a medical appointment today over this.

Appreciate any help that anyone can offer.

    Explain how the bailiff has broken the rules and ask them to tell the bailiff to remove the clamp."

    I have advised the local authority and they have said it's out of their hands. They stated I need to speak to the bailiff.

    Spoke to the bailiff who said it will not be removed unless the money is paid.

    Have you spoken to the bailiff or someone in their office?

    I assume paying the debt isnt an option? Not sure if the police would be interested or not, might be worth a go if you tell them its been erroneously clamped.
  • Enforcement agency stated that because the blue badge was not showing that gave them the authority to clamp. After I told them the car has a blue badge in it they said it is too late now, as it is in the possession of the bailiff. Car is still on my drive but apparently I no longer own it. 

    Don't seem to be making any headway with enforcement agency or bailiff. Should I badger local authority as @la531983 suggested to get it removed?

    Nothing on there suggests the blue badge has to be on display at the time. Ring their office and ask for an email address and point this out.

    What does the debt relate to, is this parking related (the section of the forum you are on), you mention the local authority, is this a council tax debt?
    Enforcement agency stated that because the blue badge was not showing that gave them the authority to clamp. After I told them the car has a blue badge in it they said it is too late now, as it is in the possession of the bailiff. Car is still on my drive but apparently I no longer own it. 
    Do you actually own the car? If it is on finance then they cannot clamp it as it is not yours in the first place.
    Don't seem to be making any headway with enforcement agency or bailiff. Should I badger local authority as @la531983 suggested to get it removed?

    The latter wont have any authority to put clamps on cars.

    They might not have the legal authority, but I am pretty sure some of them are cowboy enough to try?

    Old parking fine in my former spouses name who has since vacated and did me the good deed of not informing me of the infraction.

    I own the car.

    The enforcement agency is called Jacobs. It is a bailiff who has clamped the car but not court appointed.

    Technically the car doesn't have a blue badge, it is your son who has the badge, that you use when he is in the car to obtain the benefits that the badge entitles him to.

    What type of debt is the Bailiff/clamper trying to enforce against?
