Premier Park LTD letter before claim, owner deceased

Hi all,

My mum passed away not long ago. She got a parking fine from Premier Park Ltd in August 2024 for parking in a disabled bay with no blue badge displayed.

An appeal was sent to them explaining the situation, with photo eveidence that she had a blue badge, and explaining the van was also obviously adapted for wheelchair access.

the appeal was simply ignored and the letters from BW legal started coming. I tried to contact the parking company, but there is no email, no phone number, no address or anything to contact them, so I left it.

now she has passed away they have started sending letters before claims, I no longer have access to my mums home and I don’t even know who to contact to tell them to change the address, if I get a court date I won’t even know when it is?

I think it’s absolutely disgusting that they can get away with this, and equally disgusted with the government who hasn’t made any effort to make this sort of thing illegal,m

any help would be very much appreciated

    Use the complaint link on the BPA AOS members list to complain and to inform them that the RK is deceased   ( my condolence to you   )

    If this is PP of Exeter,  they definitely have various contact details on their website 

    The government brought in the Private Parking Bill 2019 to regulate the industry,  so 6.5 years ago,  but for various reasons the new MHCLG Code of Practice has been delayed,  but there is a current government public survey consultation going on which ends next week,  so please fill it in and try to get the changes you seek, by regulation of the industry

    I am executor of the will so I am dealing with the estate,

    Whatever contact details on their website I have tried and couldn’t manage to speak to a human, I have had no replies to any emails I’ve sent either

    i also sent a complaint to BPA in December and they replied this:

     About your Case
    You have stated you did not receive a response to your appeal. In this instance, we recommend contacting the operator directly to request a copy. 

    If they can provide a copy of your appeal response, we would not become further involved as we cannot determine what has been sent or received by either party.”

    I was unable to get any response from Premier Park and with my mothers ill health I was too busy to chase it up and spend the time on them, I just left it and hoped it would go away. Obviously this was the wrong decision

    I assume you have no access to your mother’s home is because she liked in rented accommodation. If so did she own any assets that require you to apply for probate?

    Is there an estate? If not let them crack on, a CCJ against a deceased person is meaningless and if there is no estate they wont see a penny if they attempt to enforce it. They cant force anyone else to pay it in that scenario.

    Obviously if there is an estate, dont do the above.

    There is an estate.

    i have no access to her home because her ex husband has moved back in and changed locks. It’s a complicated situation. The house is under tenants in common so it was half hers to pass down in her will, so that is a part of the estate

    Study what I wrote earlier,  because you can definitely complain to PP using the link on the BPA AOS members list 

    You need to WRITE, not phone, not speak, everything must be done in writing

    Is it worth sending a physical letter to their address? Yes I think that is the right company. If I go on the BPA AOS members list and click on complaints policy is goes to page not found..

    An example of what I was going to write but couldn’t find an email address to send to..


    “I'm writing this email to you regarding a PCN that was issued in August 2024. 
    I am aware that an appeal was sent but was ignored and you never gave a reply when it was first issued by ******.
    The reason for the PCN was parking in a disabled space without displaying blue badge. In the appeal, pictures of the blue badge were attached, so I believe you should still have evidence of these.
     you can also see that the van that was parked there is very obviously adapted for disabled access.
    ******** who you issued the PCN has since passed away after a long battle with pancreatic cancer, and I have attached a death certificate as proof. Any further correspondence from yourselves should be sent to: 

    *address*

    I am aware that a letter before claim has been sent by yourselves. I will attend myself and present my case to the court, and the case will be thrown out, wasting both your money and my time. It would be appreciated if the PCN was discarded, as it should never have gotten this far.

    I also request all evidence and details that you hold regarding this PCN, including the original appeal that was sent.
