DCD LEGAL small claims track

Hello everyone
im new on here and I really have tried to read as many posts as possible to get some help I need.
I’m actually feeling so overwhelmed by this court case I don’t know what to do next.
Last December I took my disabled aunt to m&s at crown point retail park. She needed her Christmas cake as we do this every year on the same date. That evening was a yellow weather warning the wind and rain was terrible. I remember it as the disabled parking space was water logged due to a drain in the parking spot being flooded. I had to rush out my side of the car to go help her out of her side as the floor outside her door was flooded with water. So unfortunately I had no idea the badge was blown off the dashboard.
I still didn’t notice till I was dropping her off home and then had to pick it up of the car floor.
Anyway I received a court letter on the 9th of July regarding a parking fine from December.
I had no ticket on the car or any previous letters from the parking company.
I filled out a response to this court letter explaining what happened that evening and why the blue badge was not displayed.
I have received an email from DCB asking to contact them and discuss payment. I did not reply and they also called me but left me on hold so I cut it off after 20 minutes.
Then today I received a letter from the courts saying Notice of proposed allocation to small claims court track.
Please can anyone advise me what to do or expect next
I’m extremely concerned on how much this will cost

This is all normal. See the Template Defence thread. Read the first 8 steps.

This is what I wrote as my defence before I got the letter saying they are taking it further

    Dear Sir/Madam,

Subject: Appeal Against Parking Fine for Parking in Disabled Bay

I am writing in response to the parking fine issued for parking in a disabled bay without displaying a blue badge on 23/12/24 . I respectfully request that the court consider the exceptional circumstances surrounding this incident and cancel the fine.

On the evening in question, I was shopping with my disabled aunt, who is the holder of a valid blue badge. The badge was displayed on the dashboard of my vehicle, as required, when we parked in the disabled bay. However, the weather that evening was extremely windy and rainy, creating challenging conditions. The disabled bay itself was waterlogged, making it difficult to assist my aunt out of the car without her feet getting soaked while the car door was open. During this process, with the wind blowing strongly, the blue badge was inadvertently blown off the dashboard.

I deeply regret that the badge was not visible to the parking enforcement officer at the time of inspection. This was an unintentional oversight caused by the severe weather conditions and the practical difficulties of safely assisting my disabled aunt. The blue badge is valid, and I can provide evidence of its validity if required.

I kindly ask the court to take these exceptional circumstances into account and exercise discretion in this matter. I have always ensured compliance with parking regulations, and this incident was entirely due to factors beyond my control. I would be grateful if the fine could be waived on this occasion.

Thank you for considering my appeal. Please let me know if further information or documentation is required. I look forward to your response.

    Yours sincerely,

That reads like an appeal. Is that what you either sent by email to CNBC or submitted on MCOL as your defence?

Not a good defence,  just an explanation,  a witness statement

You need to up your game going forward

    Which private parking company   ?

Which Crown point retail park   ?

N180 from the CNBC in Northampton is next, by post , not mediation

Download the N180 DQ pdf document and fill it in and save it,  ready to be emailed to the DQ email address

Study the 8 steps in the defence template thread,  you are not at step 4 yet  ( mediation   )
