Is anyone able to help with what I put in paragraph 3 please?0
-
We already did but we won't write this basIc stuff for anyone. Your defence is written except for one paragraph. You have been given a link to the page with two dozen DCB Legal cases you could copy para 3 from.Dice1 said:Is anyone able to help with what I put in paragraph 3 please?
Meanwhile, also read page one of that linked thread please. Do the Public Consultation too.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks. I have read through the page you are referring to. I dont know if Im being dumb and Im not asking for anyone to write anything for me but I still dont understand what info I need to include in this paragraph. I typed my explanation but then was told I dont admit liability so Im genuinely confused what sort of info I include here, sorry0

It's ok. Do you know how long you overstayed for?1
-
No unfortunately I cant find the original paperwork and it doesnt state any info on the court letter 😔 Im assuming it was longer than 10 minutes but wouldn't have been a lot longer than that as I paid for 3 hours and wasnt much longer I remember0
-
Ok, I would just say you paid on the app. End of. It's their onus to make their claim. They tend to discontinue anyway.
The Defendant paid to park via the Claimant's app. They appear to claim an "overstay" but do not provide any information about how long this may have been, the exact period of parking or the timescales between ANPR captures and the parking period starting and coming to an end.1 -
Perhaps add that the BPA Code of Practice allows for a minimum of 10 minutes grace period so the defendant does not believe the POC
Then show us the new draft of paragraph 3 (you write it and post it below, then we give it any critique as feedback )2 -
Yep. Try something like
The Defendant paid to park via the Claimant's app. They appear to claim an "overstay" but do not provide any information about how long they allege this to be. The British Parking Association's Code of Practice allow a 10 minute grace period, which may have caused a discrepancy as the Claimant's ANPR cameras do not capture periods of parking, only entrance and exit times.

Thank you so much, thats very helpful. I made a call 25 minutes after my parking was up so by that time I must have been back in my car and charged my phone so it cant have been more than 20 minutes max0
