You are the Part 20 Counterclaimant and you have to supply WS & evidence to support your CC and YOU have to pay the fee.

If you want your CC heard (if you think you have a valid cause of action and that in law, a financial remedy is due), you are going to have to ring the local court again and complain that they got it wrong again.

But think carefully. Is your CC likely to succeed? Will it stand up in law and how will you persuade a judge at a hearing?

Will it be in danger of appearing frivolous/meritless? You can't just say: look judge, they discontinued so I want my money back for the PCN I paid. Payment can be seen as an admission of liability. You paid 'under duress' you say, but how will you evidence that?
