If it were me I would refuse but counter offer.
I'd point out that you made a properly pleaded counterclaim based on the Claimant & DCB Legal's undeniable data abuse and escalating demands. This wore you down, into making a transactional decision you would not otherwise have made. This is a clear breach of the DMCC Act, for which the new regulator is the Competition & Markets Authority. You intend to provide your evidence to the CMA to fuel their current consumer protection drive which has identified the parking industry for scrutiny.

Here is an update. Did the above. DCB Legal wrote back saying they did not intend to proceed with the claim and would defend my counterclaim. They filed a N279 notice of discontinuance.

- you have to pay the hearing fee (not the Claimant) because the hearing is only about your counterclaim;
- do you have a deadline to pay that, and a hearing date yet?
- either way, would email the court to tell you when the hearing fee must be paid because your counterclaim is not discontinued (courts sometimes don't notice counterclaims);
- please show us the NoD attached to the DVB Legal email (do not show us the email itself). We can't count it on Umkomaas' thread without a picture of the NoD.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
