Forgot to pay NCP

I totally forgot to pay an NCP stay and just got a letter today.

However I left the car park on 2/8/25 and got the letter today 23/8/25.

Did I read that if they send the letter outside of 14 days they've broken some kind of rule, so I can appeal?

Sorry I'm WAY too stressed in general to seieve through hundreds of posts on this topic, so apologies if this has been answered dozens of times.

    ChatGPT says:

Thanks for sharing the exact dates — that makes it even clearer.

    • Date of incident: 2 August 2025

    • Date of sending (on their letter): 19 August 2025

That’s 17 days after the incident.

Now, under POFA Schedule 4, Paragraph 9(4):

    • A Notice to Keeper must be delivered not later than 14 days after the specified parking event.

    • “Delivered” means actually received by the keeper, not just “dated” or “sent”. (POFA 2012, s.9(6): service is presumed to be on the second working day after posting).

    So in your case:

    • Even if they did post it on 19 August, POFA assumes it was delivered on 21 August (2 working days later).

    • That’s 19 days after the incident.

    • Well outside the 14-day legal limit.

👉 Therefore, the notice is non-compliant with POFA and NCP cannot hold you (the keeper) liable.

You’re in a very strong position to win on appeal.

    easy win use this text

This is an appeal by the registered keeper - No driver details will *ever* be given. Please do not bother with your known fishing expedition in an attempt to get driver details.  It is known parking firms do this to try and get around the fact when there is no keeper liability in play. (and never can be under POFA)

As there is NO keeper liability then liability cannot flow from the driver to the keeper and thus is an auto win @ POPLA. Please therefore cancel the notice or issue a POPLA code where you will auto withdraw

If you waste your time asking for driver details this will be ignored and you will still lose at POPLA if you dont cancel the PCN

So let's save my time and yours and cancel this PCN you simply cannot win this (and you know it)

They are invoking PoFA in their NtK when quite clearly there is no entitlement, thereby misrepresenting their entitlement. Complain to the DVLA (let's see what ChatGPT can do on that score!).

ccrt@dvla.gov.uk (and) KADOEservice.support@dvla.gov.uk - send the same complaint to both email addresses.

Definitely report them to the DVLA for lying about keeper liability !

THEY CAN'T SAY IT WAS A MISTAKE BECAUSE THE DATES OBVIOUSLY DISALLOW THEM FROM ISSUING A POFA NTK.

Also do the appeal as keeper, shown by @ChirpyChicken

What does complaining to the DVLA achieve exactly?

Obviously my main objective is to appeal and get this cancelled.

Complain and you'll see what it achieves.

Do not miss your closing date for appealing.

You should really hit the Report flag and ask for your images in your 1st post to be removed. See IMPORTANT (yellow box) info at top of page.

    I've already appealed.

Sorry, what's the urgency to remove the top images? In case someone decides to use the info to pay my PCN for me? 🤣

If you don't know or you want to know why you shouldn't publish your name address and other identifiable information on a public forum I suggest you ask Google.

Nope. Parking firms lurk here and have used posts against people.

Complaining to the DVLA (and BPA) gets PCNs cancelled, especially this Summer whilst they are under particular government scrutiny!

Before the end of next week please do the government's Public Consultation. We need every poster to come back & complete this vital Consultation before the deadline. See this thread: -

Your case shows rogue practice: lying about the POFA, and this is evidence you can show the MHCLG to try to influence their policies.

We understand that you may need some pointers. It looks laborious, we get that. It doesn't matter; no knowledge is needed except re your own experiences so you can call out a scam industry and you'll protect millions of motorists and help change the law.

I've written some guidance on that thread. I have covered almost every question, providing ideas if you agree with our stance on things like DRFs, which we say must be banned.

Ordinary people like you are falling victim to this scam 15 million times per annum. Motorists need your voice added please.
